WHEREAS, Pursuant to resolut�ion, C. F. _ 239328, approved
July 3, ` 1968, a public hearing was duly held ori Thursday,
July 18; 1968, before the Coun.cil of the City of Saint Paul,
said hearing pertaining to the condition of the structure '
located� at 662 East Sixth Street, . Saint Paul, Min.nesota; and
� � WHEREAS, Upon the facts presented at the said hearing, con-
sisting� of photographs, inspection reports and the recommendation
of the City Architect, it is fou.nd and determined by the City
Council; that according to the records and files in the office of
the Register of Deeds, the last record own.er of the above-described
property is Reuben. Myhra; that there exists of record a mechanic' s
lien in� favor of A. Walter Av_o_les d�b�a Avoles Plumb.ing and Heating
, - � Company; and that there are no other lien holders of record; that`
it is further determined that the above-.described building consti-
tut.es a' hazardous building within the definition of Min.nesota ,
Statute�, Section 463. 15, for the following reasons: �
, a. The building is standing vacant and is subject
to�. entry by unauthorized persons and to van.dalism;

� � b. The egterior of the building is in a dilapidated
�, condition in that the wood cornice members are damaged,
the windows are broken, the siding is in need of repair,
the porch supporting column is rotted, and some are in
danger of collapse. The concrete stairs are badly broken

and the general exterior of the building is in need of
general repair;
1 c. The interior• of the building is dilapidated �^ �
and the mortar is eroded from the basement foundation stones ,
the wood supporting columns in the basement are rotted which
allows the first floor to sag, the plaster has fallen from
the walls , the interior of the building has been vandalized „
with fixtures and cabinets broken and the plumbing, elec-
trical and heating systems are out of order and in need of
repair; '
Id. The building is unfit for human habitation in its
present condition and must be corrected so as to comply
with the St. Paul Building Code and Housing Code;

e. The building constitutes a nuisance and a hazard
to ithe public peace, healt}i, safety and welfare because
• of �its physical damage, dilapidation, abandonment and
� inadequate maintenance;

RESOLVED., That� in accordance with Minnesota Statutes, Section
463. 15 through. 463. 26, and based upon the foregoing findings of ,
- the City Coun.cil , the Council of the City of Saint Paul does hereby ' ;�`
make the following Order: ,✓,-� .
ORDER
1. The owner of the above-described building shall make
the same safe and not detrimental to the� public health, safety
and welfare by having the said building razed and the materials -
� therefrom removed from the�pr-emises within thirty (30) days from
the date of the service of�' this Order, or, in the alternative,
begin to correct the hazardous conditions and correct the hazard-
• ous conditions by doing the following:

1 a. Remove all paper and other combustible materials
, �rom the building and securely close and keep closed all
� doors , windows or other openings in the building;
Ib. All of the above defective conditions must be
corrected and the wiring, plumbing and heating systems
brought up to comply with the Saint Paul Housing Code
and the Saint Paul Building Code requirements , and that
the owner submit a list of intended corrections regarding
the structural condition of the building electrical and
. heating system, together with a schedule for the comple-
tion of the rehabilitation program and that the owners ,�
apply for the necessary permit in the office of the City '"
Arichitect within the thirty (30) days imposed herein. .

2. fUnless such corrective action is taken to comply with
this Order or an an.swer served upon the City of Saint Paul and
filed in� the office of the Clerk of the District Court of Ramsey
County, Minnesota, within twenty_ (20) days from the date of the
service. of this Order, a Motion for Summary Enforcement of this
Order to� raze and remove the said building will be made to the
Ramsey County District Court.

3. i In the event that the building is to be razed by the
City of Saint Paul pursuant to judgment of the District Court,
� all personal property or fixtures� which may unreasonably interfere
with the razin and removal of this building shall be removed
. within ten (10� days from the en.try of judgment; and if not so
removed; the City of Saint Paul shall remove and dispose of such
' p.ersonal property and fixtures as provided by law.

4. � If the City of Saint Paul is compelled to take any cor—
rective � action herein, all necessary costs expended by the City
will be( assessed againat the ab.ove—de.s.cribed real estate and
collected as other taxes;' �--

j�1�REAS, Pursuant to resolution, C. F. 239328, approved
July 3, 1968, a public hearing was duly held on Thursday,
July 18, i968, before the CounQil of the City o� Saint Paul,
said hearing pertaining to the condition of the structure
loQated at 662 Eaet Sizth Street, Saint Paul, Minnesota; and
Z�ftEAS, Upon the faats presented at the said hearing, Qon-
sisting of photographe, inepeotion reporta and the recommendation
of the City Architect, it is �ound a.nd determined by the City
Counoil that aocording to the records and �iles in the o��ios of
the Register of Deeds, the last record owner o� the above-described
property is Reuben Myhrt3.; that there egists o� record a mechanio' s
lien in favor of A. S�lalter Avoles d�b�a Avoles Plumbing and Heating
Company; and that there are no other lien holdera of recordi that
it is further determined that the above-described building congti-
tutes a hazardoua building within the definition of Minnesota
Statutee, Section 463. 15, for the following reasons:
a. The building is standing vacant and is sub�ect
to entry by unauthorized persons and to vandalism;
b. The exterior o� the building is in a dilapidated
oondition in that the wood Qornioe memberg are damaged,
the windows are broken, the siding ia in need oY repair,
the porch supporting oolumn is rotted, and some are in
danger of collapse. The concrete atairs are badly broken

and the general exterior of the building is �in need of

} c. The interior of the building is dilapidated
and the mortar is eroded from the basement foundation stones,
the wood supporting columns in the basement are rotted which
allows the first floor to sag, the plaster has fallen from
the walls , the interior of the building has been vandalized
. with fixtures and cabinets broken and the plumbing, elec-
trical and heating systems are out of order and in need of
repair; �
� d. The building is unfit for human habitation in its
. �resent condition and must be corrected so as to comply
with the Sto Paul Building Code and Housing Code;
� e. The• building constitutes a nuisance and a hazard
to� the public peace, health, safety and welfare because
of; its physical damage, dilapidation, abandonment and
inadequate maintenance;

now, therefore, be it
�RESOLVED, That in accordance with Minnesota Statutes , Section
463. 15 through 463. 26, and based upon the foregoing �indings of
� the City Council , the. Council of the City of Saint Paul does hereby
make th�e following Order:
' ORDER �
- 1. The os�m.er of the above-described building shall make
the same safe and not detrimental to the public health, .safety
and welfare by having the said building razed and the materials
therefrom removed from the premises within thirty (30) days from
the dat.e of the service of this Order, or, in the alternative, �
begin to correct the hazardous conditions and correct the hazard-
ous con.ditions by doing the following:
, a. Remove all paper and other combustible materials
from the� building and securely close and keep closed all
doors, windows or other openings in the building; ,
' b. All of the above defective conditions must be
corrected and the wiring, plumbing and heating systems
brought up to comply with the Saint Paul Housing Code
� and the Saint Paul Building Code requirements , and that
the os,mer submit a list of intended corrections� regarding
the structural condition of the building electrical and
heating system, together with a schedule for the comple-
tion of the rehabilitation program and that the owners
apply for the necessary permit in the office of the City
' Architect within the thirty (30) days imposed herein.

2. IInlees such corrective action is taken to comply t,rith
this Order or an anawer served upon the City of Saint Paul and
�iled in the office of the Clerk of the Distriet Court o� I�amsey
County, Minnesota, within twenty (20) days from the date of the
servioe of th3.a Order, a Motion for Summary Enforcement o� this
Order to raze and •remove the eaid building will be made to the
Ramsey County District Court.
3. In the event that the building is to be razed by the
City o� Saint Pt�ul pursuant to �udgment of the Distriat Court,
all pe�sonal property or fixturea which may unreasonably inter�ere
with the razin and removal o� this building ahall be removed
within ten (10� days from the entry o� �udgment; and i� not so
removed, the City of Saint• Paul shall remove and dispose o� such
personal property and �ixtures ae provided by law.
4. I� the City o� Saint Paul �.s compelled to take any cor—
rective action herein, all neces�ary costa expended by the City
t,rill be asaeased against the above—desoribed real estate and
colleoted as other taxes;
and be it
FURTHER RESOLVED, That a certified Qopy o� this resolution
and inoorporated Order herein be served upon the laet record
owner of the above—deaaribed property in the manner provided
by law and also upon other intereated partiea in the manner
provided by law.

2he above property is classified as a duplex, frame construction,
two stories in height. It has a full basement approximately 24 ft. wide,
60 ft. long and 26 ft. high. Our most recent inspection reveals that the
building�is vacan� standing open and has been exEensively vandalized.

The owner of record is Reuben Myhra and the legal description
is the West 33. 18 fe et of Lot 23, Block 18, Lyman Daytons Addition to�,the
City of Saint Paul. .

A recent inspection indicates the following:

- The wood cornice members are in need of repair. There are 25
broken wi.ndows, the siding is in need of repair with portions beginning
to rot. �I'he front two-story porch supporting column is rotted, the concrete
stairs from the street are badly broken and the rear entrance platform is
badly ro�ted. The columns supporting the rear porch are rotted and one is
in danger of collapse. The full basement is limeston e construction. The
mortar is eroded from the foundation stones and the wood supporting
colusnns�are rotted at the base, allowing the first floor to sag. All the
windows iin the basement are broken.
FIRS T FLOOR
Contains fo�.r rooms and bath. The floors are buckled and sagging.
The plaster has fallen from some areas of all the rooms. The kitchen
cabinets �are smashed, the light fixtures are broken and the switches have
been removed.

� Contains six rooms and full bath. Plaster is falling from the stair

halls.� All the windows are broken and the doors a.n.d trim have been smashed
by vandals. The rooms are badly littered with debris,,the light switches and
fixtures are either removed or smashed.

j The plumbing, electrical and heating systems are out of order.

iThere are no accessory buildings on the lot.
IIf a rehabilitation schedule is not submitted by the owners, it is the
conclusion of the Bureau of Public Buildings that by reason of inadequate
maintenance, dilapidation, physical damage, unsanitary condition and
abando�nmen t, the above structure constitutes a hazard to public health,
safety and welfare. It is the further recommendation of the City Architect
that the Council concur in this conclusion and refer the matter to the City
Attorney's office for submission of this condemnation to the District Court: .
