'Marshall ' City Clerk Room 386 City Hall ' Dear Sir: ', This is in regards to the appeal of Robert Ash to relax the Zoning Code density requirements on property located on the east side of Pederson Street between Nortonia and Nokomis Avenues. This property is further described as the north 45' of Lot 14, Block 28, Beaver Lake Heights. � This matter was considered by the Board of Zoning at a public hearing held on June �20, 1968. The staff reported that the appellant proposes to build a single family residence on this site which is zoned "A" Residence. The Zoning Code requir.es a 5,000 sc�uare feet of lot area and a lot width of 40' for such a use. A platted lot, exeluding �the south 5' , was sold to Mr. Ash by th�e owner of the lot to the south:f. The sale of a;�portion of a full platted �lot resulted in a lot area of 4;460 square feet which is 540 square feet or 10.8o short of�the required lot area. Egisting zoning in the � area is "A" Residence. �Existing development in the•entire area is si.ngle family homes.� The site is vacant, level, and approximately 5' above the grade of Pederson Street. Mr. Ar,thur J. Berens of 820 Pederson Street, the owner of the lot south of the lot� in question, in a.letter dated May 3, 1968 (enclose�d) , has stated that he was unaware that the portion which he sold to Mr. Ash was undersized. Mr. Berens now utilizes the south 5' of the platted lot to the no�th of his property for access to his garage. This property is the North Forty-five (N. 45) feet of Lot Fourteen (14), Block �renty-eight (2�), Beaver Lake Heights. The above described lot wa.s origi,nally platted as a fifty foot frontage. I, kept about five feet and sold the remaining north forty-five feet of lot four- teen.. N�y blacktop driveway, using approximately five feet of lot fourteen, is on the south side of the portion sold to Mr. �sh and on the north side of my lot, Lot Fifteen (15), ffiock �renty-eight (28). When I subdivided lot fourteen, I was unawaxe that the portion to be sold was undersized. I was informed at the courthouse in 1966, when adding the five feet to my land,� that it would be satisfactory to sell the remainder of lot fourteen. This sa1� of the remainder of lot fourteen was handled by my attorney, Gordon Sinclair. Certainly, no trouble for Mr. Ash was anticipated as a result of the sale. In April, 1968, I applied for a building permit, and �ras denied the permit because of the size of the" lbt. At that time, I tried to bny five feet fron the former o�rner, svho lives to the right of the_lbt. He refused to sell any part of hia lot a� he feela he� needs it �or hus drive�vay. The buialding of a house on the lot will bring in 'more taaes to the city and also improve the area. If this is not granted, the� lot is a uaeless piece of property and the city just collecta tazes �or an empty lot. � I zrould appreciate your granting this appeal, as it has been a great hardship for me.
