that part of Danforth Street lying southerly of the south right-of-way line of Arlington Avenue
and northerly of the north right-of-way line of Cottage Avenue, and the east-west and north-south
alleys as dedicated in the plat of Rose Mary Piace, Ramsey County, Minnesota.
BE IT FURTHER RESOLVED, that, subject to the herein stated exceptions and with the
accompanying Utility Easement Certificates of Intended Non-Use, filed voluntarily on behalf of Qwest
Corporation, Northern States Power Company, d.b.a. Xcel Energy, District Energy St. Paul, Inc. and
District Cooling St Paul, Inc., MCI Network Services, Inc., Comcast of Saint Paul, Inc., Saint Paul
Regional Water Services, and the Deparhnent of Public Works, made a part hereof by this reference and
filed in the office of the City Clerk of Saint Paul, the City, for itself and on behalf of these corparations
and departments, waives the right to the utility easements in the vacated area described above.
This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
Saint Paul Legislative Code as amended, and to the following conditions:

That the petitioner's, their successors and assigns shall pay $1,200 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That the petitioner, their successors and assigns shall grant private access easements, if needed,
to allow the property owners at 585 Cottage Ave W., and 580 and 586 Arlington Avenue W. to
access their garages.
That the petitioner shall be responsible for the reconstruction of any existing street openings or
alley openings affected by this vacation, to eliminate the appearance of a public thoroughfare,
including, but not limited to, all costs and expenses for the removal or reconstruction of curbs,
gutters, sidewalks, boulevards, drainage structures, and signs.

That the petitioners, their successors and assigns agree to indemnify, defend and save harmless
the City of Saint Paul, its officers and employees from ali suits, actions or claims of any chazacter
brought as a result of injuries or damages received or sustained by any person, persons or
property on account of this vacation or petitioners' use of this property, including but not limited
to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
because of any claims or liability arising from any violation of any law or regulation made in
accordance with the law, whether by the petitioners or any of their agents or employees.
21 6. That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
22 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution
23 and sha11, within the period(s) specified in the terms and conditions of this resolution, comply in
24 all respects with these terms and conditions.

PETITION TO VACATE CITY INTEREST
I(we), the undersigned, consflrutine a majoriry of the owners (or their legally designated representafives) of the abutung properties, do
hereby pefition the CouncIl of the City of Saint Paul to vacate iu interesu in the property(ies) legally descnbed as follows:
The petitioner does herby petition the Council of the City of Saint Paul to vacate its
interests in the properties described as follows:Vacate Danforth Street from the south
side of Arlington Ave. to the north side of Cottage Ave. We wish to leave a driving
easement from the north side of Cottage Ave. to the back of the property located at
585 Cottage Ave. Also, vacate the existing alley from the east side of Danforth St.
to the west side of Kent St. Plus from the south side of that alley to the north side
of Cottage Ave.
I(we) request [his vacation for the foliowing reason(s). (Indicate whether you will be building on the site.)
The vacating of these parcels is for possible future expansion of The Church of the
Maternity of the Blessed Virgin. These parcels are currently maintained by the Church
and have been for many years.
I(we) have attached six copies of the site plans of any development intended for construcbon on the lands to be vacated.

The Department of Public Works has reviewed the above requested vacation. Danforth is an
unimproved, unassessed, 30 ft. wide right-of-way. The 20 ft. wide "T" alley in Rose Mary Place
is also unimproved and unassessed. There are three properties that use Danforth to access their
garages. 585 Cottage Avenue W. has their garage off of Danforth. And 580 and 586 Arlington
Avenue W. have their garages off the alley, where they need to use Danforth and part of the alley.
Therefore, we have no objections to this vacation proposal subject to the following conditions.
1. That the petitioner, their successors and assigns shall grant private access easements to allow
the property owners at 585 Cottage Ave W., and 580 and 586 Arlington Avenue W. to maintain
access to their garages.
2. That the peutioner shall be responsible far the reconstruction of any existing street openings
or alley openings affected by this vacation, to eliminate the appearance of a public tharoughfaze,
including, but not limited to, all costs and expenses far the removal or reconstruction of curbs,
gutters, sidewalks, boulevazds, drainage structures, and signs.
In addition, the City Surveyor has suggested the use of the following description for the alley
vacation: "...and the east-west and north-south alleys as dedicated in the plat of Rose Mary
Place, Ramsey County, Minnesota."
