Addition and lying southerly of the following described line:
Commencing at the northeast corner of said Block 5, thence on an assuxned bearing of South 00
degrees 09 minutes 56 seconds East along the east line of said Block 5, also being the east line of
Orchard Street as dedicated on the plat of Hillside Pazk Addition (now known as Germain
Street), 463.15 feet to the point of beginning, thence South 89 degrees 38 minutes 30 seconds
West, 30.00 feet to the west line of Germain St and there terminating, said point of termination
being 269.44 feet north of the point intersection of the south line of said Block 5 wiYh the west
line of Germain Street as measured along the west line of Germain Street.
BE IT FURTHER RESOLVED, that, subject to the herein stated exceptions and with the
accompanying Utility Easement Certificates of Intended Non-Use, filed voluntarily on behalf of Qwest
Corporation, Northern States Power Company, d.b.a. Xcel Energy, District Energy St. Paul, Inc. and
District Cooling St Paul, Inc., MCI Network Services, Inc., Comcast of Saint Paul, Inc., Saint Paul
Regional Water Services, and the Department of Public Works, made a part hereof by this reference and
filed in the office of the City Clerk of Saint Paul, the City, for itself and on behalf of these corporations
and departments, waives the right to the utility easements in the vacated area described above.
This vacation sha11 be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
Saint Paul Legislative Code as amended, and to the following conditions:

6 to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
7 because of any clauns or liability arising from any violation of any law or regulation made in
8 accordance with the law, whether by the petitioners or any of their agents or employees.
