2 WHEREAS, Chapter 293 of the Samt Paul Legislative Code was enacted to regulate the subject of noise in
3 the City of Samt Paul; and

5 WHEREAS, §293.11 provides for the grantmg of variances from the sound level limitations contained 'm
6§293.09, upon a finding by the City Council that fiill compliance with Chapter 293 would constitute an unreasonable
7 hardship on an applicant, other persons or on the comunmity; and

9 WHEREAS, Pillars Investment Group, LLC, represented by Toua Xiong, owner, who has been designated
10 as the responsble person on the application, bas applied for a variance to allow live music at 217 Como Ave.; and
11
12 WHEREAS, applicant is seel�g a variance for the hours of 10:00 a.m to 6:00 p.m. August 7-8, 2004; and

14 WHEREAS, if applicant is not grauted a variance it will not be able to present a live band; and
15
16 WHEREAS, the Office of License, Inspections, and Environmental Protection has reviewed the application
17 and has made recommendations regazd'mg conditions for the variauce; now, therefore, be it
18
19 RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to Pillars Investment Crroup
20 LLC, subject to the followmg conditions:

1) The variauce shall be for the hours of 10:00 a.m to 6:00 p.m for August 7� 2004

2) All electronically powered equipment used in conjunction with the event shall not
exceed 90 dBa as measured from 50 feet from the noise source
3) The applicant shall provide personnel and equipment who shalt pmvide continuous
sound level monitoring between 10:00 a.m. and 6:00 p.m on the date to ensure
compliance with Condition #2.
