Resolution approving and providing for execution �
of proposed Code Enforcement Grant Contract, num--
bered Contract No. Minn. E�2(G) between the City
of Saint Paul and the United States of America,
pertaining to a certain Code Enforcement Program
desigriated Code Enforcemen.t Program No. Minn. E-2.
_ WHEREAS, un.der Section 117 of the Housing Act of 1949, as
amended, the United States of America (herein called the "Govern—
ment" ) has tendered to the City of Saint Paul (herein called the
"Grantee" ) a proposed Code Enforcement Contract, pursuan.t to which
the Government would egtend certain Federal financial assistance
to the Grantee in connection with the Code Enforcement Program
described herein; and
WHEREAS, the Grantee has given due consideration to said ,
proposed Contract; and �
WHEREAS, the Grantee is duly authorized, under and pursuant
to the Constitution and Laws of the State of Minnesota; to under—
take and carry out said Code Enforcement Progr.am .a�.d to execute
such proposed Contract:

NOW� THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF� SAINT PAUL as follows :
Section l. The proposed C�ntr-a,ct, designated "Code En-- "
forcement Grant Contract No. Minn. E-2(G) , providing for the
making by the Government to the, Grantee of a Code Enforcement
Grant under Section'll7 of the Fiousing Act of 194g, as amended,
in connection witli the Code, Enforcement Program described therein
and designated as Code Enforcement Program No. Min.n. E-2, is
hereby in all respects approved.
;x Section 2. The Mayor and City Comptroller are hereby
authorized and directed to execute said proposed C�ontract in

two counterparts on behalf of the Grantee, and the City Clerk
is hereby authorized and directed to impress and attest the offi-
cial seal of the Grantee on each such counterpart and to forward
such counterparts to the Department of Housing and Urban Develop-
ment, together with such other documents relative to the approval
and execution thereof as may be required by the Govern.ment.
Section 3. The Mayor is hereby authorized to file requisi-
tions, together with necessary supporting documents, with the
Government, in accordance with the Code Enforcement Grant Contract,
requesting payments to be made on account of the Code En.forcement
Grant ;provided in the Code Enforcement Gr•ant Contract, and to do
and perform all other things and acts required to be done or per-
formed in order to obtain such paymen.ts.
Section 4. This resolution shall take effect immediately.

1. I have e�amiiied the record of all pi oceediilgs, including,
particularly, tha,t certain resolution adopted on the 30th day o�
July,. 1g68, by i;he City Council of tlze City o� Saint Paul (herein
called the Grantee" ) relative to the authorization, approval and
execution of i;hat ceri;ain Code Enfoicement Grant Contract (herein
� called the "Con�t;raci;" ) referred to therein and numberecl Contract
No. Minn. E-2(G) , by and between the Grantee and the United States
of America (herein called the "Goverruuent" ) . I have also e�amined
the two counterparts of the Contract as executed on behalf of the
Grantee.
2. It is my opinion tha�t; : �
(a) Said proceedings have been �aken, said resolu�ion
has been adopted, and the Contract has been exe-
cuted on behalf of the Grantee by its proper
officials , in form, man.ner, and otherwise as
authorized by las�.
(b) When each of the counterparts of the Contract shall
have been duly executed by tlze Goverivuent , the Con.-
tract will coilstitute a valid, binding, and legal
arrangenient bet�,reeil the aforesaid parties thereto �
in accordance with its terms. '-
, 3. I HEREBY CERTIFY TIIAT:
(a) None of said proceedings and no authority for the �
• authorization, execution, and delivery of the Con-
tract have or has been repealed, rescinded, or
' revoked, and said. resolution is in full force and
effect.
(b) No litigation of any nature is now pending or '�'
threatened (in either State or Federal courts)
- restraining or enjoining the Grantee' s execution
of the Contract or in any manner qu.estioning or
affec�;ing the validity tllereof or of the proceecl-
� ' ings aforesaid, and neither the coiporate exist-
ence nor the legally prescriUecl area o� operation
of the Grantee nor the title of its. �presen�; officers
' to their respective offices is being contested.
