04-738e RESOLUTION OF NT PAUL�IC(I Presented By Referred To Council File # Oy-� Green Sheet # 3019336 ESOTA ttee: Date 23 1 WIIEREAS, Neighborhood Housing and Property Improvement (NHPn has requested the City 2 Council to hold public hearings to consider the advisability of revoking the rental registration certificate 3 for a single family rental property located at 551 Michigan Street and registered to Dadders Holdings 4 LLC; and 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 WHEREAS, on April 19, 2004, NHI'I conducted an inspecrion of said property and issued Suinuiary Abatement Order for sanitation with a compliance deadline of Apri123, 2004; and WHEREAS, on May 4, 2004, NHPI conducted a reinspection of said property and found lack of compliance with the previous arder; and WHEREAS, on May 5, 2004, NHI'I sent the holder of the rental registration certificate for the subject property, Dadders Holdings LLC, a$SQ excessive consumption bill, addressed to 92Q Atlantic St., Unit lOQ St. Paul, MN 55106-3434, the address on said certificate; and WHEREAS, as of June 28, 2004, said $50.00 has not been paid, and Legislative Code §51.06 (a) (v) provides that non-payment of fees for excessive consumption is grounds for certificate revocation; and WHEREAS, on May 5, 2004, NHPI notified Dadders Holdings LLC of the need to arrange an interior inspection of the subj ect properiy; and WHEREAS, as of June 28, 2004, an interior inspection has not been arranged, and Legislative Code §51.07 (a) (iii) provides that the imposition of an excessive consumption fee is grounds for an interior inspection; and WHEREAS, on 3une 30, 2004, NHPI sent Dadders Holdings LLC the proper Notice of Intent to Revoke Rental Registration (copy attached); and WHEREAS, Dadders Holdings LLC has not appealed said notice and the time far filing an appeal has expired; now therefore BE IT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the following findings and order concerning the subject properry at 551 Michigan Sireet. C�►�1-�3F� Once the City Council has revoked the rental registration certificate, occupancy of the property is not allo�ved until (1) an inspection by Neighborhood Housin� and Property Improvement (i�THPn has been conducted, (2) the Director of NHPI has determined the property to be in compliance, and (3) the certificate is renewed. Note: Rentin� a property without a certificate is a misdemeanor. Please call me as soon as possible to arrange a meetin� to discuss how to correct this situation before the City Council acts to revoke this certificate. If all issues are addressed, I will recommend that the revocation be withdrawn from consideration by the City Council.
