04-737Council File # `� � Green Sheet # RESOLUTION Presented By Referred To 3019275 ZZ 1 WHEREAS, Neighborhood Housing and Property Improvement (NIIPn has requested the City 2 Council to hold public hearings to consider the advisability of revoking the rental registration certificate 3 for a single family rental property located at 927 Iglehart Avenue and registered to Mark Cemensky; and 4 5 WHEREAS, on January 6, 2004, IVFIPI conducted an inspection of said property and issued 6 Correction Order for accessory siructure with a compliance deadiine of May 1, 2004; and WHEREAS, on May 3, 2004, NHPI conducted a reinspection of said properiy and found lack of 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 compliance with the previous order; and WHEREAS, on May 4, 2004, NIIPI sent the holder of the rental registration certificate for the subject property, Mark Cemensky, a$50 excessive consumption bill, addressed to 2343 Swan Drive, Mendota Heights, MN 55120, the address on said certificate; and WHEREAS, as of June 28, 2004, said $50.00 has not been paid, and Legislative Code §51.06 (a) (v) provides that non-payment of fees for excessive consumption is grounds for certificate revocation; and WHEREAS, on May 4, 2004, NIII'I notified Mark Cemensky of the need to arrange an interior inspection of the subject property; and WHEREAS, as of June 28, 2004, an interior inspection has not been arranged, and Legislative Code §51.07 (a) (iii) provides that the imposition of an excessive consuxnption fee is grounds for an interior inspection; and WHEREAS, on June 30, 2004, NHPI sent Mark Cemensky the proper Notice of Intent to Revoke Rental Registration (copy attached); and WHEREAS, Mark Cemensky has not appealed said notice and the time for filing an appeal has expired; now therefore BE IT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the following findings and order concerning the subject property at 927 Iglehart. That the subject property is a single family rental property that is required to be registered with the City's Rental Registration Program. Kellogg Boulevard, St. Paul, l�LN or you may appeal by mail within the same 13 day rime line. t�t-l3� Once the City Council has revoked the rental registration certificate, occupancy of the property is not allowed until (1) an inspection by Neighborhood Housing and Proper[y Improvement (NHPn has been conducted, (2) the Director of NHPI has detemrined the property to be in compliance; and (3) the certificate is renewed. Note: Rentin� a property without a certificate is a misdemeanor. Please call me as soon as possible to arrange a meeting to discuss how to correct this situation before the City Council acts to revoke this certificate. If all issues are addressed, I will recommend that the revocation be withdrawn from consideration by the City Councii.
