04-734CounCil File # "� J Green Sheet # 3019261 RESOLUTION ( q CITY OF SAINT PAUL, MINNESOTA Presented By Referred To Committee: Date WHEREAS, Neighborhood Housing and Property Improvement (NIIPn has requested the City Council to hold public hearings to consider the advisability of revoking the rental rea stration certificate for a duplex rental property located at 734 Fuller Avenue and registered to Gregory O. Evans; and WHEREAS, on March 16, 2004, NfIPI conducted an inspection of said properiy and issued Correction Notice for sanitataon with a compliance deadline of March 29, 2004; and WHEREAS, on March 29, 2004, NHPI conducted a reinspection of said properiy and found lack 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 of compliance with the previous order; and WHEREAS, on March 30, 2004, NHPI sent the holder of the rental registration certificate for the subject property, Gregory O. Evans, a$50 excessive consumption bill, addressed to 699 Aurora Avenue, St. Paul, MN 55104-4812, the address on said certificate; and WHEREAS, as of June 28, 2004, said $50.00 has not been paid, and Legislative Code §51.06 (a) (v) provides that non-payment of fees for excessive consumption is grounds for certificate revocation; and WHEREAS, on March 30, 2004, NHPI notified Gregory O. Evans of the need to arrange an interior inspection of the subject property; and WHEREAS, as of 3une 28, 2004, an interior inspection has not been arranged, and Legislative Code §51.07 (a) (iii) provides that the imposition of an excessive consumption fee is grounds for an interior inspection; and WHEREAS, on June 30, 2004, NHPI sent Gregory O. Evans the proper Notice of Intent to Revoke Rental Registration (copy attached); and WHEREAS, Gregory O. Evans has not appealed said notice and the time for filing an appeal has expired; now therefore BE IT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the following findings and order concerning the subject property at 739 Fuller Avenue. That the subject property is a duplex rental property that is required to be registered with the Ciry's Rental Registration Program. ', . -. 2. 3. 4. 5. That said certificate holder has been requested to allow an interior inspection of the subject property, which has not been arranged. Note: Renting a property without a certificate is a misdemeanor. Please call me as soon as possible to arrange a meeting to discuss how to correct this situation before the City Council acts to revoke this certificate. If all issues are addressed, I will recommend that the revocation be withdrawn from consideration by the City Council. Note: Renting a property without a certificate is a misdemeanor.
