WHEREAS, Neighborhood Housing and Property Improvement (NIIPn has requested the City
Council to hold public hearings to consider the advisability of revoking the rental rea stration certificate
for a duplex rental property located at 734 Fuller Avenue and registered to Gregory O. Evans; and
WHEREAS, on March 16, 2004, NfIPI conducted an inspection of said properiy and issued
Correction Notice for sanitataon with a compliance deadline of March 29, 2004; and
WHEREAS, on March 29, 2004, NHPI conducted a reinspection of said properiy and found lack

of compliance with the previous order; and
WHEREAS, on March 30, 2004, NHPI sent the holder of the rental registration certificate for the
subject property, Gregory O. Evans, a$50 excessive consumption bill, addressed to 699 Aurora Avenue,
St. Paul, MN 55104-4812, the address on said certificate; and
WHEREAS, as of June 28, 2004, said $50.00 has not been paid, and Legislative Code §51.06 (a)
(v) provides that non-payment of fees for excessive consumption is grounds for certificate revocation;
and
WHEREAS, on March 30, 2004, NHPI notified Gregory O. Evans of the need to arrange an
interior inspection of the subject property; and
WHEREAS, as of 3une 28, 2004, an interior inspection has not been arranged, and Legislative
Code §51.07 (a) (iii) provides that the imposition of an excessive consumption fee is grounds for an
interior inspection; and
WHEREAS, on June 30, 2004, NHPI sent Gregory O. Evans the proper Notice of Intent to
Revoke Rental Registration (copy attached); and
WHEREAS, Gregory O. Evans has not appealed said notice and the time for filing an appeal has
expired; now therefore
BE IT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the
following findings and order concerning the subject property at 739 Fuller Avenue.
That the subject property is a duplex rental property that is required to be registered with
the Ciry's Rental Registration Program.

That the holder of the Rental Registration Certificate for the subject property is Gregory

That said certificate holder has been billed for excessive consumption of code inspecrion
services, which has not been paid.
That said certificate holder has been requested to allow an interior inspection of the
subject property, which has not been arranged.
That the notification requirements of Chapter 51 have been fulfilled and the time for an
appeal has expired without an appeal being made.

The Saint Paul City Council hereby makes the following order:

The above-referenced Rental Registration Certificate issued to Gregory O. Evans for the
duplex rental property at 739 Fuller Avenue, Saint Paul, MN is hereby revoked.
It is further ordered that a copy of this resolution be mailed to Gregory O. Evans.

I am writing to you in your capacity as the holder of a rental registration certificate for 739 Fuller Avenue, St.
Paul MN.
You are hereby notified, pursuant to the authority granted to me under Chapter 51 of the St. Paui Legislative
Code, of the City's intent to revoke the registration certificate for 739 Fuller Avenue based on the following:
On Mazch 16, 2004, this departrnent conducted an inspection of said property and issued a
Correction Notice for sanitation with a compliance deadline of March 29, 2004.

compliance with the previous order.
On Mazch 30, 2004, this deparhnent sent you a$50.00 bill for the cost of said reinspection.
As of today this $50.00 has not been paid.
On March 30, 2004, this department notified you by mail of the need to arrange an interior
inspecrion of said rental property.

until (1) an inspection byNeighborhood Housing and Property Improvement (NHPn has been conducted, (2)
the D'uector of NHPI has determined the property to be in compliance, and (3) the certificate is renewed. Note:
Renting a property without a certificate is a misdemeanor.
Please call me as soon as possible to arrange a meeting to discuss how to correct this situation before the City
Council acts to revoke this certificate. If all issues are addressed, I will recommend that the revocation be
withdrawn from consideration by the City Council.
