WHEREAS, Neighborhood Housing and Property Improvement (NHPn has requested the City
Council to hold public hearings to consider the advisability of revoking the rental registration certificate
for a single family rental property located at 1028 Carroll Avenue and registered to Drake Dexter L.
Wiley; and
WHEREAS, on May 6, 2004, NHPI conducted an inspection of said property and issued
Correction Order for sanitation with a compliance deadline of May 11, 2004; and
WHEREAS, on May 11, 2004, NHPI conducted a reinspection of said property and found lack of
compliance with the previous order; and
WHEREAS, on May 12, 2004, NIIPI sent the holder of the rental registration certificate for the
subject property, Drake Dexter L. Wiley, a$50 excessive consumption bill, addressed to 492 County
Road B2 W, Roseville, MN 55113-3518, the address on said certificate; and
WHEREAS, as of June 28, 2004, said $50.00 has not been paid, and Legislative Code §51.06 (a)
(v) provides that non-payxnent of fees for excessive consumption is grounds for certificate revocation;
and
WHEREAS, on May 12, 2004, NHPI notified Drake Dexter L. Wiley of the need to arrange an
interior inspection of the subject property; and
WHEREAS, as of June 28, 2004, an interior inspection has not been arranged, and Legislarive
Code §51.07 (a) (iii) provides that the imposirion of an excessive consumprion fee is grounds for an
interior inspection; and
WHEREAS, on June 30, 2004, NHPI sent Drake Dexter L. Wiley the proper Notice of Intent to
Revoke Rental Registration (copy attached); and
WIIEREAS, Drake Dexter L. Wiley has not appealed said notice and the time for filing an appeal
has expired; now therefore
BE IT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the
following findings and order concerning the subject property at 1028 Carroll Avenue.

1. The above-referenced Rental Reastration Certificate issued to Drake Dexter L. Wiley for
the single family rental property at 1028 Carroll Avenue, Saint Paul, MN is hereby
revoked.
2. It is further ordered that a copy of this resolution be mailed to Drake Dexter L. Wiley.

I am writing to you in your capacity as the holder of a rental registration certificate for 1028 Carroll Avenue, St.

You are hereby notified, pursuant to the authority granted to me under Chapter 51 of the St. Paul Legislative
Code, of the City's intent to revoke the registration certificate for 1028 Carroll Avenue based on the following:

Once the City Council has revoked the rental rea stration certificate, occupancy of the property is not allowed
until (1) an inspection by Neighborhood Housing and Property Improvement (NHPn has been conducted, (2)
the Director of NHPI has determined the property to be in compliance, and (3) the certificate is renewed. Note:
Rentin� a properiy without a certificate is a misdemeanor.
Please call me as soon as possible to arrange a meeting to discuss how to correct this situation before the City
Council acts to revoke this certificate. If all issues are addressed, I will recommend that the revocation be
withdrawn from consideration by the City Council.
