1 WHEREAS, Neighborhood Housing and Properiy Improvement (NI-II'n has requested the City
2 Council to hold public hearings to consider the advisability of revoking the rental registration certificate
3 for a single family rentai property located at 550 Blair Avenue and registered to Joseph E. Baltierrez; and

5 WHEREAS, on May 13, 2004, NHPI conducted an inspection of said property and issued
6 Correction Notice for sanitation with a compliance deadline of May 19, 2004; and
7
8 WFIEREAS, on May 20, 2004, NHPI conducted a reinspection of said properiy and found lack of
9 compliance with the previous order; and

WHEREAS, on May 21, 2004, NHPI sent the holder of the rental registration certificate for the
subject property, Joseph E. Baltierrez, a$50 excessive consumption bill, addressed to 598 Blair Avenue,
St. Paul, MN 55103-1638, the address on said certificate; and
WHEREAS, as of June 28, 2004, said $50.00 has not been paid, and Legislative Code §51.06 (a)
(v) provides that non-payment of fees for excessive consumption is grounds for certificate revocation;
and
WHEREAS, on May 21, 2004, NHPI notified Joseph E. Baltierrez of the need to arrange an
interior inspection of the subject property; and
WHEREAS, as of June 28, 2004, an interior inspection has not been arranged, and Legislative
Code §51.07 (a) (iii) provides that the imposirion of an excessive consumption fee is grounds for an
interior inspection; and
WHEREAS, on June 30, 2004, NHPI sent Joseph E. Baltierrez the proper Notice of Intent to
Revoke Rental Registration (copy attached); and
WHEREAS, Joseph E. Baltierrez has not appealed said notice and the time for filing an appeal
has expired; now therefore
BE IT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the
following findings and order conceming the subject property at 550 Blair Avenue.

- - 1. That the subject property is a single family rental properiy that is required to be registered �'
with the City's Rental Registration Program.
That the holder of the Rental Registration Certificate for the subject property is Joseph E.
Baltierrez.
2.
That said certificate holder has been billed for excessive consumption of code inspection
services, which has not been paid.

That said certificate holder has been requested to allow an interior inspection of the
subject property, which has not been arranged.

That the notification requirements of Chapter 51 have been fulfilled and the tune for an
appeal has expired without an appeal being made.

The Saint Paul City Council hereby makes the following order:
The above-referenced Rental Registration Certificate issued to Joseph E. Baltierrez for
the single family rental property at 550 Blair Avenue, Saint Paul, MN is hereby revoked.

It is further ordered that a copy of this resolution be mailed to Joseph E. Baltierrez.
