Gentlemen:
Enclosed is a petition for the re-zoning of the above captioned property for
commercial purposes . The petition is brought in behalf of Fixst State Bank of
Saint Paul. The Bank has recently purchased Lot twleve (12) , included in the
petition, and has a first option to purchase Lot eleven (11) , which is also
included in this petition for re-zoning.
The First State Bank of Saint Paul desires to make a parking lot and driveway
out of the property, intending to direct traffic from it's drive-in teller windows
onto Lawson Street, rather than to direct this traffic onto Payne Avenue from the
alley between Lawson and Jenks Avenues . Traffic on Payne Avenue has been
seriously congested for sometime on Friday evenings when the Bank customers
have had to exit- from the Bank property through this alley.
The attached petition includes the names of all of the registered owners and
contract purchasers of all effected lots, save and except the signatures of
Mr. & Mrs. Albert Berg, the owners of Lot nineteen (19) in Block seven (7) , and
Mr. & Mrs . E. A. and E. W. Nelson, the owners of Lot ten (10) in Block fourteen
(14) . Both of these parties indicated they would join in the petition only if a
. cash consideration was paid to them.

Dear Sir:
This is 9.n regards to the petition of First State Bank to rezone from
"B" Residence (single and two family homes) to Commercial property located �
on the south side of Lawson Avenue between Payne &venue and Greenbrier
. Street. This property. is• further deseribed as Lots 11 and, l2;- Block 14,
. Arlington Hills Addition.� The petitioner proposes to develop the site as
.• an off-street park'ing facility �i�.si drive-in teller egress for the bank to
the southwest. The parking lot would possibly serve other Payne Avenue
commercial aetivities in the evenings.
This matter was considered by the Board of Zoning at a public hearing
. held on April 4, 1968. The �onunissioner of Finance_.had declared the petition
sufficient with the owners of 17 of a possible 20 (85�) tracts within the
required 100' having signed the petition. The staff reported that existing
zoning consists of Commercial for the frontage along Payne Avenue and "B"
Residence for the general .area.on either side of the Payne Avenue frontage.
It should be noted that nine feet of the lot to the west of the area under
consideration remains zoned "B".Residence and is a non-conforming use.
This nine feet should be rezoned to Commercial in the future. Existing
development in the area consists of commercial uses along the Payne Avenue
frontage, and a mixture of single family homes, duplexes, and four-plexes
in the remainder of the area. South of the site in.question is a parking
lot adjoining-the bank. Immediately east is a four-plex. The Comprehensive
Plan recommends commereial uses along Payne Avenue from Lawson Avenue south
to York Avenue for a depth approximately to the alley lines. The plan also
recommends medium density residential use to the north of Lawson Avenue.
Mr. Hansen of 701 Lawson Avenue, appeared in opposition. Mr. Hansen
spoke of concern for maintenance of the parking lot , use of the lot after
the bank is closed, and possi.ble glare of lights. .
It was the findings of the Board that there. is a critical need for parking
in the area.' The applicant has stated that there is an acute need for an
improved.egress from the bank drive-in windows as the present egress (to the
west out the alley) is dangerous. The Comprehensive Plan recommends that '
the commercial use in this area continue. The latest draft of a new Zoning

Code would allow such parking use in a zoning district called a Vehicular
Parking District. An accessory parking lot would not be detrimental to
the surrounding area if given proper design.
Therefore, the Board of Zoning reeommended approval of the petition to
rezone from '!B" Residence to Commercial provided that a parking lot layout
be submitted to, the Zoning Board staff and approved by the staff before the
rezoni.ng._petition recommendation is presented to the Council. It should be
noted that such a plan has been submitted and given preliminary approval.
.Among other things, this plan incorporates a basket-weave screen fence
along the east side of the property and a low planter wall along the north
side of the property.
