Resolved, That upon the petition of
the Americari FIOist and Derrick Com-
pany, that section of public�street
hereinafter described be and the same
hereby is vacated and discontinued
as a publlc street:
That part oP Livingston Avenue
lying between the north line of
vacated E�llmore Street and a line
drawn parallel' with and 5p £eet
northwesterly,of a line drawn from
the northeast corner of, Biock 176
of Robertson's Addition to West
St. Paul, to the northwest corner
of Block 4 of 1Vlaishall's Addition
to West St. Paul (which said last
described line is hereinafter called -
the Levee Line); �
subject expressly to the£ollowing con-
ditions and reservations:
1. That the vacation be subject to
all the terms and conditions of �
Section 228 of the Legislafive
Code, as amended.
2. That a specific easement be re-
tained to protect the interest of
the Northern States Power Com-
pany. �
3. That the American Hoist and
Derrick Company construct a
meter pit on the 6-inch water
main on Livingston Avenue, the
pit to be located approximately
on the north line of Fillmore
Street, with all necessary pipe
work to place the meter on the
8-inch main to be done''�at the
expehse of the petitioner. The
Water Department will furnish
and install the required meter
after the necessary pipe;work is
completed.
4. The maintenance operatioa and
all future responsibility for all
pipe and ap�urtenances beyond
the meter will become the re-
sponsibility of the American Hoist
and Derrick Company,
5. That the -�ietitioner pay to the
Citq the sum of$8,900 as compen-
satlon for the vacatlon and fur-
_ nish the City with a bond in the
amount of $5,000. '
