WHEREAS, Pursuant to proper notice duly given as required
by law, the Cou.ncil of the City of Saint Paul has met and heard and
passed upon all objections to the proposed assessment by the City
in wrecking and removing the hazardous building located at 535
Carroll Avenue; now, therefore, be it
7 � RESOLVED, That the proposed assessment roll, a copy of which
is attached hereto and made a part hereof, be and the same is hereby
in all respects ratified, accepted and adopted, and shall constitute
the special assessment again.st the lands named therein; be it
FURTHER RESOLVED, That the said assessment be and is hereby
determined to be payable in one installment; be it
FURTHER RESOLVED, That the City Clerk shall forthwith trans–
mit a certified copy of this assessment to the County Auditor to be
egtended on the proper tax lists of the county, and such assessment
shall be collected and paid over in the same manner as other munici–

Gentlemens
8 The Couna3l, on June 19, 1968, held a publia hearing to consider
the assessment of aost.s inaurred by the City in wrecking and removing
the hazardous building located at �35 Carroll Avenue, Saint Panl. Mr.
Milton Barber, Sr., of 937 �'$�11 Avenue, appeared to protest his not
being adequately notified of the assessment hearing. The followin�
is a �report of actions taken by onr office in regard to the said
hazardous build3ngs
August 3, i967- Council Order was served upon Arthur E. Thom., Inc.�
mortgagee of record.
July 31� 1967- Gounail Order served by mail upon Vivia.l Rnth Washington.
2640 Caldwell, Omaha, Nebraska� owner of reaord.
August 1, 1967- Le�ter reee3.ved by Robert L. 9mes, City Arahitect,
• from Arthnr T. Tho�.., Jr., stating that, oa behalf
of Mrs. Washing�ton, the city is requested to wreck
and remove the sub�eat hazardous building (copy attached)
August 7, i967- Letter from myself to Arthur T� Thom, Jr., infox�ing
him that if the City is to wreck the bnilding its
aosts shall be collected in the form of a tax against
the property (copy attaahed)
August 28� 1967- Notiae of Lis Pendens filed in the Office of the
Register of Deeds.and copiss mailed to Mrs.
Washington and Mr. Thom.
September 15, 1967- Hearing before District Court and District
Coui-t Order filed authorizing the City to forthwith
wreck arid remove the said hazs�rdou� building and a�sess
its costs against the property.

October 4, 1967- Quit Claim Deed filed in Office of the Register
of Deeds.conveying title to snb�eat property to
Milton S. Barber, Sr.
October 11� 1967- Council Resolution anthorizing purchasing of
neaessary wreaking services for estianated aost
of $1�000.00
May 17, 1968- Resolution setting hearing on proposed assessment .
against the sub�ect property for wreaking of the
hazardous building, in the amount of $7�+3.54•
, Jnne 19, 1968- Hearing held to assess costs, and continued to
Jul,y 3, 1968 for report from the Corporation Counsel
" and City Arahitect.
IIpon investigation into this matter it is � conclusion that Nir.
Milton S. Barber, Sr.� r�ras given adqc�uate notice of the councilts
action in regard to the �recking of the hazardous building, and also
3n regards to the proposed a�sessment. Mr. Barber was notified by mail
of the hearing �.o be held on June 19th as proven by affid,avit in the
Council�s file and signed Uy Nett3 A. Grabscheid of the eity Clerkts
Office.
The deed aonveying the property to Mr. Ba�ber was filed in the ,
Register of Deeds Office after the date of filing of the Notice of
Lis Pendens, and he should have adequate notice of the Councilts order
that the building be wrecked.
In conclusion, a11 requirements of law have been met in this regard
and the Counail possesses the rightful� aathority to levy the asse�sment
against the property involved herein.

in the council chambers July 20th last regarding these premises.
Mrs. 4dashington says she is unable to raise the money necessary ,
to renovate the structure and is unable to rais.e money to have
the building wrecked and she therefore asks that the city take
