Gentlemen: � � '
On September 2, 1964, your Honorable Body granted a
special use permit to the Lyn.nhurst Nursing Home to construct
an addition to its facility located at 471 Lynnhurst Ave. W. ,
Saint Paul, to incre"ase its capacity from 23 to 67 beds.
I am advised that the owners of the home desire to _
construct an additi.on thereto which would substantially increase �
its capacity. Our opinion was requested by the office of the
City Architect as to whether this addition required a reference
to the Planning Board and public hearing, or any amendment to
the special use permit originally granted on September 2, 1964.
While I have substantial doubts as to the alidity of
the 1964 attempt to impose a bed limitation on this property, in �
view of the fact that the Council saw fit to impose the limita- 1
j tion four years ago, I do not feel that a permit should be
�1� issued for this construction unless the Council has again been
given an opportunity to review the situation. �
If it is the •desi`re of your Honorable Body to permit •
this addition, it is my opinion that, under the present terms of
the Zoning Code, there is no necessity for another public hearing
at this time or any reference to the Plannin.g Board.
I attach a resolution which will authorize the issuance
of a building permit to the petitioner. ' ,
