1 BE IT RESOLVED, that, as documented in Real Estate Division File Number 04-Cul-de-sac02, and
2 subject to the herein stated exceptions and with the accompanying Utility Easement Certificates of
3 Intended Non-Use, filed voluntarily on behalf of Qwest Corparation, Northern States Power Company,
4 d.b.a. Xcel Energy, Dishict Energy St. Paul, Inc. and Dishict Cooling St Paul, Inc., MCI Network
5 Services, Inc., Comcast of Saint Paul, Inc., Saint Paul Regional Water Services, and the Department of
6 Public Works, made a part hereof by this reference and filed in the office of the City Clerk of Saint Paul,
7 the City, for itself and on behalf of these corporations and departments, waives the right to the utility
8 easements in the vacated rights-of-way described below:
9 Parcel 1. The alley in Block 9, Edmund Rice's Fourth Addition, Ramsey County, Minnesota and
10 lying between Lots 3, 4, 5, 6, 7 8, 9 and 10 in said Block 9.
11 Parcel2. All that part of the north-south alley between Blocks 7 and 8 which lies south of a line
12 drawn from the northeast corner of Lot 1, Block 8 to the northwest corner of Lot l, Block
13 7 and north of the easterly extension of the south line of Lot 3, Block 8 all in Srinson's
14 Addirion to the City of Saint Paul, Ramsey County, Minnesota.
15 Parcel 3. All of Arkwright Street lying between Blocks 6 and 7, Stinson's Addition to the City of
16 Saint Paul, Ramsey County, Minnesota, lying north of the extended south line of I,ot 15,
17 said Block 6 and lying south of a line drawn from the northeast comer of Lot l, said

10 1. That the petitioner's, their successors and assigns shall pay $$300.00 as an administrative fee for
11 this vacation which is due and payable within 60 days of the effective date of this resolution.
12 2. That a permanent utility easement shall be retained within Whitall Street between Arkwright and
13 Weshninster Street to protect the interest of Qwest Corporation and that the developer of the
14 property shall bear any and all costs, including the acquisition of easements, associated with
15 relocating Qwest Corporation's existing facilities.

3. That the petitioners, their successors and assigns agree to indemnify, defend and save harmless
the City of Saint Paul, its officers and employees from all suits, actions or claims of any character
brought as a result of injuries or damages received or sustained by any person, persons or
property on account of the release of the said easements or petitioners' use of this property,
including but not limited to, a claim brought because of any act of omission, neglect, or
misconduct of said petitioners or because of any claims or liability arising from any violation of
any law or regulation made in accordance with the law, whether by the petitioners or any of their
agents or employees.

same time, I sent out Certificates and Inquiries on File # OS-2004, and 04-C-02 is to release
easements in vacated streets and alleys in the same project, but the upshot is that I sent two
copies of OS-2004 instead of one of each. Please disregazd one of the Certificates I sent last
week, and substitute tlus one.
