2 WIIEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in
3 the City of Saint Paul; and

5 WHEREAS, §293.11 provides for the granting of variances from the sound level limitarions contained in
6§293.09, upon a finding by the City Council that full compliance with Chapter 293 would constitute an
7 unreasonable hardship on an applicant, other persons or on the community; and
8
9 WHEREAS, Luis Palau Evangelistic Association, represented by Aaron Cole, Production Manager, who has
10 been designated as the responsible person on the application, has applied for a variance to allow live music at the
11 Capitol Grounds.; and

13 WHEREAS, applicant is seeking a variance for the hours of 9:00 a.m. to 10:00 p.m. August 7 and 8, 2004;
14 and
15
16 WHEREAS, if applicant is not granted a variance it will not be able to present amplified music far their two
17 day music festival; and

19 WHEREAS, the Office of License, Inspections, and Environmental Protecrion has reviewed the application
20 and has made recommendations regarding conditions for the variance; now, therefore, be it
21
22 RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to the Luis Palau
23 Evangelistic Association, subject to the following conditions:

25 1) The variance shall be for the hours of 9:00 a.m. to 10:00 p.m. for August 7 and 8,

28 2) All electronically powered equipment used in conjunction with the event shall not
29 exceed 100 dBa as measured at a point 100 feet in front of the main stage and 100 feet
30 directly in front of all delay speakers

1 . 3) The applicant shall provide personnel and equipment who shall provide conrinuos
? sound level monitoring between 9:00 am. and 10:00 p.m. on the dates to ensure
3 compliance with Condition #2.

5 4) All electronically powered equipment, PA systems, loudspeakers or similar devices shall
6 be turned off no later than 10:00 p.m. on August 7 and 8, 2004.

Aazon Cole of the Luis Palau Evangelisrio Association has requested a sound Ievel variance for amplified outdoor music at the Capitol
Grounds for August 7 and 8; 2004 for the hours of 9:00 a.m to 10:00 p.m.
Advantages If Approved:
Will place conditions that will limit the sound impact on surrounding residential and commercial areas.
Disadvantages If Approved:
Persons living or working neaz the Capitol will be able to hear the sounds from the amplified music.
Disadvantages If Not Approved: � •
The sound level impact on surrounding residential and commercial azeas could be greater with no conditions. Applicant may not be
able to present the music without exceeding the sound level limitations contained in 293.09.

Attached is a sound level variance applicarion from Aazon Cole, production manager,
representing Luis Palau Evangelisric Association, 1500 167th Place NW, Beaverton, OR
97006, to allow live music. A variance is requested for the hours of 9:00 a.m. to 10:00
p.m. for August 7 and 8, 2004.
Enclosed is the copy of the Public Hearing Notice sent to property owners within 200 feet
of 100 Rev Dr Martin Luther King Jr Blvd.
