04-656Council File # � Green Sheet # 3017666 RESOLUTION A� 1 WHEREAS, Neighborhood Housing and Property Improvement (NHPn has requested the City 2 Council to hold public hearings to consider the advisability of revoking the rental registration certificate 3 for a duplex rental property located at 769 Burr Street and registered to Terry L. Buchanan and 4 S WHEREAS, on April 1, 2004, NIIPI conducted an inspection of said property and issued a 6 Correction Order for sanitarion with a compliance deadline of April 15, 2004; and 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 WHEREAS, on Apri121, 2004, NHPI conducted a reinspection of said properiy and found lack of compliance with the previous order; and WHEREAS, on Apri122, 2004, NHPI sent the holder of the rental registration certificate for the subject property, Terry L. Buchanan, a$50 excessive consumption bill, addressed to 652 36`� Avenue NE, Minneapolis, MN 55418-1202, the address on said certificate; and WIIEREAS, as of May 27, 2004, said $50.00 has not been paid, and Legislative Code §51.06 (a) (v) provides that non-payment of fees for excessive consumption is grounds for certificate revocation; and WHEREAS, on Apri122, 2004, NHI'I notified Terry L. Buchanan of the need to arrange an interior inspection of the subj ect property; and WHEREAS, as of May 27, 2004, an interior inspection has not been arranged, and I,egislative Code §51.07 (a) (iii) provides that the imposition of an excessive consumption fee is grounds for an interior inspection; and WHEREAS, on June 7, 2004, NHPI sent Terry L. Buchanan the proper Notice of Intent to Revoke Rental Registration (copy attached); and WHEREAS, Terry L. Buchanan has not appealed said notice and the time for filing an appeal has expired; now therefore BE IT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the following findings and order concerning the subject property at 769 Burr Street. 1 2 3 4 � 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 1. That the subject property is a duplex rental property that is required to be registered wrtri ` the City's Rental Registrarion Program. . 2. 3. 4. 5. That the holder of the Rental Registration Certificate for the subject property is Terry L. Buchanan. That said certificate holder has been billed for excessive consuxnption of code inspecrion services, which has not been paid. That said certificate holder has been requested to allow an interior inspection of the subject property, which has not been arranged. That the notification requirements of Chapter 51 have been fulfilled and the tune for an appeal has expired without an appeal being made. ••� • The Saint Paul City Council hereby makes the following order: 1 2. The above-referenced Rental Registrarion Certificate issued to Terry L. Buchanan for the duplex rental property at 769 Burr Street, Saint Paul, MN is hereby revoked. It is further ordered that a copy of this resolution be mailed to Terry L. Buchanan.
