04-655Council File # �� �� Green Sheet # 3017667 RESOLUTION PAUL, MINNESOTA 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 Presented By � Referred To Committee: Date 2'1 WHEREAS, Neighborhood Housing and Property Improvement (NF�n has requested the City Council to hold pubiic hearings to consider the advisability of revoking the rental registration certificate for a single family rental properry located at 27Q Brimhall Street and registered to Bernstson Properties, LLC and WHEREAS, on Apri13, 2004, NHPI conducted an inspection of said properly and issued a Vehicle Abatement Order for vehicle violation with a compliance deadline of April 11, 2004; and WHEREAS, on April 14, 2004, NHPI conducted a reinspection of said property and found lack of compliance with the previous order; and WHEREAS, on Apri126, 200A, NHPI sent the holder of the rental registration certificate for the subject property, Bernstson Properties, LLC, a$SO excessive consumption bill, addressed to 13865 Forest Boulevard North, Augo, MN 55038-8430, the address on said certificate; and WHEREAS, as of May 27, 2004, said $50.00 has not been paid, and Legislative Code §51.06 (a) (v) provides that non-payment of fees for excessive consumption is grounds for certificate revocation; and WHEREAS, on Apri126, 2004, NHPI notified Bernstson Properties, LLC of the need to arrange an interior inspection of the subject properry; and WI3EREAS, as of May 27, 2004, an interiar inspection has not been arranged, and Legislative Code §51.07 (a} (iii) provides that the imposition of an excessive consumption fee is grounds for an interior inspection; and WHEREAS, on June 7, 2004, NHPI sent Bernstson Properties, LLC the proper Notice of Intent to Revoke Rentai Registration (copy attached); and WHEREAS, Bernstson Properties, LLC has not appealed said notice and the rime for filing an appeal has expired; now therefore BE IT RESOL'VED, that based on the foregoing, the Saint Paul City Council hereby adopts the following findings and order concerning the subject properiy at 270 Brimhall Street. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 2. °`�`�� ' l. That the subject property is a single family rental property that is required to be regi stere with the City's Rental Registration Program. That the holder of the Rental Registration Certificate for the subject properiy is Bemstson Properties, LLC. Z. That said certificate holder has been billed for excessive consumption of code inspection services, which has not been paid. 3 That said certificate holder has been requested to allow an interior inspection of the subject property, which has not been arranged. L� That the nofification requirements of Chapter 51 have been fulfilled and the time for an appeal has expired without an appeal being made. 5. •'� ' The Saint Paul City Council hereby makes the following order: The above-referenced Rental Registration Certificate issued to Bernstson Properties, LLC far the single family property at 270 Brimhall Street, Saint Paul, MN is hereby revoked. 1. Note: Rentin� a property without a certificate is a misdemeanor. Please call me as soon as possible to arran�e a meeting to discuss how to correct this situation before the City Council acts to revoke this certificate. If al1 issues are addressed, I wi11 recommend that the revocation be withdrawn from consideration by the City Council.
