WHEREAS, Pursuant to resolution, C. F. No. 236993, approved February 6, 1968, a public hearing was duly held on. Tuesday, February 20, 1968, before the Coun.cil of the City of Saint Paul, said hearing pertaining to the `�,on33�� of the structure located ' at 852 Concordia Avenue, Saint Paul, l�innesota; and WHEREAS, Upon the facts presented at the said hearing con– sisting of photographs, inspection reports and the recommendation of the City Architect, it is found and determined by the City Council that according to the records and files in the office of the Register of Deeds, the last record own.er of the above--described - . property is Anna Kundschier, �also known as Anna Kunschier; that there is an Old Age Assistance Lien; that real estate taxes since 1964 are delinquent; and that there are no other lien holders of record; and that it is further determined that the above–described building constitutes a hazardous building within the definition of Minnesota Statutes Section 463.15 for the following reasons: a. The building is standing vacant, abandoned and is subject to entry by unauthorized�=persons; b. In the event that the building is to be razed by the City of Saint Paul pursuant to judgment of the District Court, all personal property or fixtures which may unreasonably interfere with the razing and removal of this building shall be removed within ten (10) days from the entry of judgment; and if not so removed, the City of Saint Paul shall remove and dispose of such personal property and fixtures as provided by law. 4. The owner of the above—described building shall make the same safe and not detrimental to the public health,. safety and welfare by having the said building razed an.d the materials therefrom removed from the premises within twenty (20) _ days from the date of the service of this Order or, in the alternative, repair the build— ing so as to comply with the Saint Paul Build�ing and Housing Codes. 2. Olson .� Coun.cil Recorder City Clerk' s Office � Subject: File No. 192'7 -- 852 Concordia Avenue Dear Sir: � The Coun.cil held a hearing on the above-described hazardous building on February 20, 1968, and at that time directed that the building be corrected or wre:cked. The State of Min.nesota and Ramsey County have Old Age Assistance Liens on this property, and I had contacted Mr. Robert J. Moore of the Welfare Department on February 28, 1968, in regard to what the county wished to do with the building. At that time Mr. Moore informed me that the county would sell the property and require that the new owner wreck the hazardous building. On May 13 I again contacted Mr. Moore to determine whether he had sold the property; and by letter dated May 15, 1968, a copy of which is attached hereto, Mr. Moore informed me that he has been unable to sell the property. The attached resolution orders and directs that the hazardous buildirig at 852 Concordia be wrecked or removed and if not that the City of Saint Paul will wreck the same an.d assess its costs against the property in the form of a special assessment. Will you please arrange to have this resolution published four on i e Saint Paul Legal Ledger; and upon its a option by the Council, return to me ten (10) certified copies of the same. Byrne, Mayor and Members of the City Council Re: File No, 1927--852 Concordia Gentlemen: The Building Department is hereby submitting its report on the condition of the property known as 852 Concordia Street, a single family frame dwelling, one and one-half stories in height, approximately 16 ft, wide, 45 ft. ' long and 26 ft, high. The building is vacant at the present time and has been secured. However, it is generally dilapidated, with the following conditions in evidence. The chimney mortar joints have eroded, causing the bricks to be loose. The exterior wood siding is beginning to rot and loosen due to lack of exterior maintenance and paint. T'he porches, both front and rear, and the steps serving them are rotting. The rain gutters have rusted out. T'he roof is sagging. 'We have not been able to check the interior of the property because it has been kept secured. However, this department has received a letter from Mr. Haines 5abean, Administrator of the Estate of Charles Kundschier, and attorney for the County Welfare Department, indicating that there is a welfare lien against the property in the amount of $13, 108 and that they have no plans for re'habilitating the property but have offered it for sale. It is t'herefore the conclusion of the Bureau of Public Buildings that by reas on of inadequate maintenance, dilapidation, physical damage, uns'.anitary condition and abandonment, the above structure constitutes a hazard to public health, s:aEety and welf�a.re. It is the further recomrriendation of the writer that the Council concur and refer the matter to the City Attorney for submission of this condemnation to District Court.
