RESOLVED, That upon and pursuant to the pertinent appeal,
under the Zoning Code, by Yale Johnson, own.er of the subject
real estate, situate in the City of Saint Paul and described as:
Lots 16, 17, 18 and 19, Block 16, Sylvan
Park Addition;
that the provisions of said Zoning Code hereby are determined
and varied as and to the extent necessary therefor and the
off—street parking requirements are hereby relaxed from 20
cars to 15 cars, subject to the eondition that said appellant,
and his successors and assigns, otherwise, shall make due com—
pliance with all applicable provisions o� municipal ordinances ,
state statutes and rules and regulations of public authorities

Dear Sir: �
This is in reference to the appeal of Yale Johnson to relax the off-
� street parking requirements on property located at the northwest corner
of Pascal Street and Randolph Avenue. This property is further described
as Lots 16, 17, 18 and 19, Block 16, Sylvan Park Addition. The appellent
proposes to relax the off-street parking space requ�rement from 20 cars
to 15 cars.
This matter was considered at a public hearing before the� Board of Zon-
ing on April 4, 1968. The staff reported that the site in question-has
two apartment structures on it. A 14 unit building was constructed '
prior to the amendment to the Zoning Code which requires parking spaces
for each housing unit. �A six unit apartment was constructed in 1964.
The six-unit structure was built on theTsame platted lots as the 14 unit
building. Therefore, it was determined by the Building Department that
the two structures would have to be considered as one development, there-
by requiring a total of 20 off-street parking spaces. A permit for the
20 car parking lot was granted in 1964, but only 15 off-street parking
spaces were constructed.
�he existing area development consists of single-family homes to the
east, north and west of the site-in question, and Derham Hall High School
to the south. The applicant has stated that conditions encountered dur-
ing excavation precluded construction of the parking area as planned,
and necessitated construction of a four-foot retaining wall which elimin-
ated five parking spaces. ,
It is the responsibility of the appellant to show a physical hardship for
an appeal. It is now impossible to tell if a physical hardship in the land
existed before construction. However, it appears there was no hardship and
that the retaining wall could be moved to provide more parking.
The Zoning Board' received a letter in opposition to the appeal from Mr.
Felix A. Gagnier of 472 Sos Warwick Street who lives across the alley
to the west of the subject property. Mr. Gagnier states that more parking
should be provided because of congested parking in the alley.

It was the conclusion of the Board of Zoning that the appellant has
proven no hardship and that the granting of the appeal would only
legalize an illegal use. Therefore, the Board of Zoning recommends
the denial of the appeal to relax the off-street parking requirements.

northwest corner of Pascal and Ra.ndolph, St. Pau1, Minnesota, known and •

Ra.msey County, Minnesota.
The property is presently improved with two multiple dwellings,
one of which is a l�+ unit apastment fronting on Randolph a.nd being in excess
of 30 yeass in age, and the other being a 6 apartment unit about 3 years in
age. The off-street parking plan, as filed and approved by the City Council
prior to the construction of the second apartment building, showed off-street
paxking space for 20 vehicles, but due to topographical problems it was
necessary to construct a stone retaining wall on the premises, reducin� the
number of available parking spaces to 15, as shown in the attached plan,
as prepared by Northwest Design. This appeal is necessitated by reason
of a change in plans required after co�nencement of construction of the
second building.

This appeal is made pursuant to Sections 60.23, Paragraph 2,
and �4.03, Paragraph i, of the Legislative Code ,of the City of St. Paul.

There is an apartment building owned by Yale Johnson on the
corner of Ra.ndolph and Pascal that was apparently e�panded without
adequate public hearing and without regaxd to adequate off.�street
1 parking facilities. This area is badly congested with stxeet parking
and it is believed that if at a7.1 possibTe this safety hazard should
be corrected. The streets are narrow and James comes to a dead end
at Pascal that adds to the hazard when cars are parked on the street.
In this connection I have heaxd that a request has been made to
build ano�her apartment on the South side of Randolph between Pascal
and Warwick. This would only add to the congestion and the traffic
hazards. I don�t believe that opening up this property to single
�amily �dwelling units if desired wuuld be objectionable nor a safety
problem. It is $i.rtua].ly impossib�e now to get onto Randolph from '
Pascal due to the flow of traffic and the fact that the on-street
parking situation impairs ones ability to see oncoming cars.
Your cooperation in correcting the above and/or not permitting
it to worsen will be appreciated. '

� or not a fence along side the subject property is on the alley
� right-of-way and whether the present traffic situation is hazardous.

} . The alley has never been officially graded. The fence is on the
� subject property and not in the alley right-of-way. A drawing of
; a survey showing the location of the fence is attached. You will
� also find a copy of a letter addressed to this office from Mr. Robert G.
� Peterson dated Ma 14 1968 which he states he does not feel the

� This area was reviewed around 8:00 P.M. on Monday, May 13, 1968. At
� that time there were nine cars in the 15 car parking lot iocated at the
� northwest corner of the above raferenced intersection, and just two cars
, parked on Pascal between Randolph and James, In discussing the matter
; with the resident located at the southeast corner of James and Pascal he
' indicated that there had never been any serious parking probiem and that
four or five cars were the most ever parked on this one block of Pascal .
; • ihere were street oiling cones to be effective on Tuesday morning which
j may have reduced the parking occurring at that time,
�1 Two cars were parked on the north side� of Randolph between Pascal
and I�arwick where the north-south alley enters Randolph. We do not

� feel this situation warrants any special parking restrictions and is
I no different from thousands of simiiar• situations throughout the city
'� where vehicles parked along streets do cause some sight distance diffi-
