WHEREP,S, The City of St. Pa.u1 having acquired the real estate hereinafter
described for public purposes and said land has been reported by the Co�issioner .
of Public Works to be surplus to the needs of the City of St. Pa.ul, in compliance
with Ordinance No. 133og, C.F. No. 229610, approved August 10, 1966; and
WHEREAS, The City of St. Pa.u1, by its Crn�issioner of Public Works, ha,s sub-
mitted a petition proposing the vacation of said public grounds, which wi7.1 be
considered by the City Council on June 11, 1968, for the following described tract:

Also subject to the following restriction: No advertising signs or billboards
may be placed upon the lands, with the exception of signs placed dn buildings
indicating the business conducted therein; the real estate shall not be used as
an automobile junk yard or as a repository for rubbish i.n any form.
NOW, TI�REFORE, BE IT RESOLVID That the Council of the City of St. Paul does
hereby accept and adopt the findings and recoffinendations of the Covnnittee on Lands
that said land as previously described be disposed of, subject to approval by the
City Council of the vacation petition, and sub�ect to a building setback restric-
tion of 132 feet from the center line of John Ireland Boulevaxd, and any landscape
plantings on this property must be reco�ended by the Parks Department and approved
by the City Council, for conformance w�ith the over-all aesthetic consideration of
John Ireland Boulevaxd; said disposal to be in conforma.nce with Ordinance No. 13309�
` C.F. N�. 229610, Section l, Subparagraph 5, approved Au�u.st 10, 1966, which speci-
fies that if the Council determines by resolution passed by five affirmative votes
that the use to which such property will thereafter be put is of i.mportance to the
general welfare of the public and may be of greater significance to the well-being
of the co�unity than the highest price that may be offered for such property, the
Council may by such resolution direct that proposals for the purcha,se of such
lands be called for by the Purchasing Agent, in accordance with said Ordinance,
and that the Pizrcha,sing Agent be directed to obtain an appraisal of said property
from the City Valuation Engineer and proceed to offer and advertise the proposed
sale as prescribed herein;
AI�ID BE IT FURTI�R RESOLVID, That after passage, approval, and publication of
this resolution approv:i.ng the project of dispasing of subject real property owned ,
by the City of St. Pau1, copies of said resolution shall be forwaxded to the Pur-
chasing Agent, to the City Comptroller, and to the Committee on Lands, by the City
Clerk.

Peterson, Covnnissioner of Public Works, and the Cha,rles T. Mi11er
Hospital, Inc., on June 11, 1968, which proposes to vacate:

The Charles T. Miller Hospital has proposed plans for construction of
a hospital paxking ramp, which has necessitated submitting a petition
to vacate a portion of Iglehart Avenue, as well as the aforesaid pro-
perty, to make such construction possible.
Therefore, in order to bring this matter to the attention of the City
Council, we, the Committee on La.nds, do hereby reco�end that the
Council of the City of St. Pau1 direct that said land be offered at
a public sale to be conducted by the City Purchasing Agent by proposals
as f�,irther detailed in Ordinance No. 133og, C.F. No. 229610, approved
August 10, 1966, Section l, Subdivision 5, subject to approvalof the
petition requesting vacation of said land, by affirmative action of the
City Council.
And we do ftiirther recora�nend that a building setback of 132 feet t�rom
the center line of John Ireland Boulevard be observed and that ar�y
landscape plantings on this property be recommended by the Parks De-
partment and approved by the City Council, for conformance with over-
all aesthetic consideration of John Ireland Boulevaxd.
