Wf3EREA5, the properiy owner of the West Side Community Health Clinic site, properry located at
153 Cesar Chavez Street (fka as Concord St.), has requested the release of City rights to a portion of
parkland donated by the HRA on Concord Terrace Plat No.l on Mazch 1,1982, said parkland abuts the
above-mentioned property address; and

WHEREAS, the St. Paul Pazks Commission has approved the conveyance of the above-menUOned
parkland for other equivalent properry abutting the remaining pazk area, said equivalent property is
owned by the above-mentioned property owner. T'his exchange is equitabie and beneficial to both the
City and the requesfing property owner, as indicated in the St. Paul Pazks and Recreauon Commission's
Resolution Numbered 04-07, adopted May 12, 2004, a copy of which is attached hereto; and

WHEREAS, the Department of Pazks (Parks) concurs, by this resolution, that the portion of parkland to
be released is surplus to the needs of Pazks; and
WHEREAS, a valuation of the parkland to be released will be determined by an independent appraisal
as outlined in Chapter 13.01.1 of the City Charter; and
WHEREAS, the property owner of 153 Cesar Chavez Street and Parks, on behalf of the City, are in
agreement that this exchange of property is equitable, beneficial and the exchange of properties will best
benefit the City as outlined in Chapter 51A1 (10) and as determined by the City's valuation engineer; so
THEREFORE BE IT RESOLVED, the property rights to the parkland under considerafion is hereby
released ofits City interest; and
FURTHER RESOLVED, the proper City officials are hereby authorized and directed to enter into an
agreement with the property owner of 153 Cesar Chavez Street to exchange the released City property
for equitable propeny abutting the remaining Pazks property.

RESOLUTION 04-07
WHEREAS, the Saint Paul Pazks and Recreation Cominission is an appointed body established to
advise the Mayor and City CouncIl on long-range and city-wide matters related to Pazks and Recreation; and
WHEREAS, Section 13.01.1 of the City Charter requires that the Commission review any diversion or
disposal of park property and present a recommendation to the City Council, and
WHEREAS, the City of Saint Paul, Division of Pazks and Recreation, owns a pazcel of property lmown as
Parque Castillo located between Concord Street and Clinton Avenue, and
WHEREAS, the West Side Community Health Services at 153 Concord Street owns adjacent land located
between Concord Street and Clinton Avenue, and
WHERFAS, to improve the use and development potential of both properties, it is in the interest of the City
and West Side Community Health Services to reconfigure their respecuve properties, and
WHEREAS, the City of Saint Paul, Division of Parks and RecreaUOn and the West Side Community Health
Services desire to trade property of approximately the same size, and
WHEREAS, a trade is supported by the West Side Citizen's Organization to improve the use of the park, and
WHEREAS, the Ciry and the West Side Community Health Services in acknowledgment of the mutually
beneficial result of conveying said properties, wish to convey their respective properties to the other party at no cost,
and
NOW THEREFORE BE 1'I' RESOLVED, that the Parks and Recreation Commission concurs with the trade,
BE Tf FURTHER RFSOLVED, that the Saint Paul Parks and Recreation Commission finds that the
reciprocal conveyance of properties is indeed of mutual benefit to the City Community Health Services, and with
respect to the provisions of Section 13.01.1 of the City Charter, therefore recommends approval by the City Council
with the value of the properties to be equal to one another, such that there is no cost to either party for the property
obtained from the other.
