2 WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in
3 the City of Saint Paul; and
4
5 WI�REAS, §293.11 provides for the granting of variances from the sound level limitations containe3 in
6§293.09, upon a fmding by the City Council that full compliance with Chapter 293 would constitute an
7 unreasonable hardship on an applicant, other persons or on the community; and
8
9 WHEREAS, International Market Place, represented by Toua Xiong, owner, who has been designated as the
10 responsible person on the application, has applied for a variance to allow live music at 217 Como Ave.; and
11
12 WHEREAS, applicant is seeking a variance for the hours of 8:00 a.m. to 7:00 pm. June 26-27, 2004; and
13
14 WHEREAS, if applicant is not granted a variance it will not be able to present live band for their grand
15 opening; and
16
17 WHEREAS, the Office of License, Inspections, and Environmental Protection has reviewed the application
18 and has made recommendations regarding condidons for the variance; now, therefore, be it
19
20 RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to Interna6onal Mazket
21 Place, subject to the following conditions:

23 1) The variance shall be for the hours of 8:00 a.m. to 7:00 p.m. for June 26-27, 2004
24
25 2) All electronically powered equipment used in conjunction with the event shall not
26 exceed 90 dBa as measured from 50 feet from the noise source

3) The applicant shall provide personnel and equipment who shall provide continuous �� "`3�
sound level monitoring between 8:00 a.m. and 7:00 p.m. on the date to ensure
compliance with Condition #2.
4) All electronically powered equipment, PA systems, loudspeakers or similaz devices shail
be turned off no later than 7:00 p.m. on June 26, 2004 or June 27, 2004.

A public hearing before the City Council will be held on June 23, 2004 at 5:30 p.m., 3rd floor
City Hall Council Chambers, at the Saint Paul City HalllRamsey Counry Courthouse, 15 West
Kellogg Boulevard, Saint Paul, MN 55102.
You should be present at the hearing to respond to quesrions that the City Council may haue.
