04-630.q l�'r EIV 1�� i� b� 2 3/4�- RESOLUTION SAINT PAUL, MINNESOTA Presented By CounCil File # v�� ��� Resolution # Green Sheet # �� 1 2 WHEREAS, Chapter 293 of the Saint Paui Legislative Code was enacted to regulate tl�e subject of noise in 3 the City of Saint Paul; and 4 5 WI3EREAS, §293.11 provides for the granting of variances from the sound level limitations contained in 6§293.09, upon a finding by the City Council that full compliance with Chapter 293 would constitute an 7 unreasonable hardship on an applicant, other persons or on the community; and 8 9 WHEREAS, MA Mortenson, Co, represented by Grey Greenwald, Assistant Project Manager, who has been 10 designated as the responsible person on the application, has applied for a variance to allow consriuction work to 11 take place on the Minnesota Public Radio (MPR) building at 45 7"' St. E.; and 12 13 WHEREAS, applicant is seeking a variance for the hours of 7:00 a.m. to 5:00 p.m. for the days of June 13, 14 2004 through October 1, 2006; and 15 16 WHEREAS, if applicant is not granted a variance it will not be able to perform the necessary construction 17 work; 18 19 WHEREAS, the Office of License, Inspections, and Environmental Protection has reviewed the application 20 and has made recommendations regarding conditions for the variance; now, therefore, be it 2l 22 RESOLVED, that the Council of the City of Saint Paul hereby grants a variance for MA Mortenson, Co, to 23 permit construction work on the MPR building at 45 7�' St. E., subject to the following conditions: 24 25 -�-} . . . . . , 26 , 27 28 1) The variance shall be for the hours of 9:00 a.m. to 5:00 p,m.
