2 WHEREAS, Chapter 243 of the Saint Paul L,egislative Code was enacted to regulate the subject of noise in
3 Che City of Saint Paul; and

5 WHEREAS, §293.11 provides for the granting of variances from the sound levei limitations contained in
6§293.04, upon a finding by the City Council that full compliance with Chapter 293 would constitute an
7 unreasonabie hardship on an applicant, other persons or on the community; and
9 WHEREAS, Taste of Minnesota, represented by Ron Maddox, Generai Managar, who has been designated
10 as the responsible person on the application, has applied for a variance to a11ow amplified music on four stages at
11 Harriet Island, from 7uly 1-5, 2004; and

13 WHEREAS, applicant is seeking a variance for the hours of 11:00 a.m. to 10:3Q p.m. for 7uly 1-5, 2Q04; and

15 WHEREAS, if applicant is not granted a variance it will not be able to present the amplified music ; and

17 WHEREAS, the Office of License, Inspections, and Environmental Protection has reviewed the applicarion
18 and has made recommendations regarding conditions for the variance; now, therefore, be it

RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to Taste of Minnesota,
subject to the foilowing conditions:

The variance shall be for the hours of 11:00 a.m. to 10:30 p.m. July 1-5, 2004.
All electronically powered equipment used in conjunction with the event sha11 not
exceed l02 dBa as measured at the closer of the sound mix or at a distance of 100 feet
from the front of the stage.

� 3) The applicant shall provide personnel and equipment who shall provide continuous
3 sound level monitoring at all stages and each sound mix between ll:00 a.m. and
4 1030 p.m. July 1-5, 2004.

6 4) All electronically powered equipment, PA systems, loudspeakers or similaz devices shall be turned
7 off no later than 1030 p.m. on the date, including all area encompassing this event.

Taste of Minnesota, Harriet Island
Attached is a sound level variance application from Rox Maddox, general manager,
representing Taste of Minnesota, 1097 Payne Avenue to allow live music. A variance is
requested for the hours of 11:00 a.m. to 10:30 p.m. for July 1-5, 2004.
Enclosed is the copy of the Public Hearing Norice sent to property owners within 200 feet
of 75 Water St. W. (Harriet Island).
