Re: Council request in regards to , � " Contract 66-M-368, Levy No. 7, � � ��`�� District No. 3, Sidewalk Assessments. �� • , Gentlemen: _ •r - At a hearing held April 10, 1968, in connection with the above matter, , , ; ' the Council requested a written report because of a complaint from a Mrs. • , Dorothy Engel , who resides at 933 Case Avenue. Mrs. Engel stated that her ��� ', , sidewalk had been in good condition and there was no need to take it out. , � She also submitted photographs which she says was the condition of the . ' sidewalk prior to the City replacement p►-oject. � We have made an investigation ' � ,' and have contacted Mrs. Engels. Our inspector's report shows that prior to , . our construction the sidewalk was cracked, heaved, off grade and in need of reconstruction. Our records fur;ther indicate that this walk was originally , constructed by a contractor by the name of H. P. Peterson, under permit date q• � August lg,• 1941 . This would make the walk approximately 26 years old at the � � time of our reconstruction. We are of the opinion fihat Mrs. Engel should be ' � assessed in the same manner as the balance of the residents of this block. ` , • The Council fu'rther directed the Department of Public Works to contact a - Mr. Elmer Olson, 1095 E. Fourth Street, who complained that his new walk has . • - spalled to some extenfi. We have made an inspection of Mr. Olson's walk and ' , �• . � � further informed Mr. Olson that the spalled portions of his walk will be• replaced, " , �� and have further irformed the District Contractor that he should take • , � ' immediate action in this regard. ' � • In reference to the complaint of Mr. Knute T. DeVahl , 1457 Edgerton Street, ' . •_ : he complained regarding the amount of walk removed and replaced. Following our - � � . preliminary investigation, we recommended removal of five panels because of � ' , . tree heave. ' . � , At a hearing held April 10, 1968, in connection with the above matter, � • , � the Council requested a written report because of a complaint from a Mrs. ' , , - , - Dorothy Engel � who re5ides at 933 Case Avenue. Mrs. Engel stated that her - • 5 , sidewalk had been in good condition and there was no need to take it out. , . She also submitted photographs which she says was the condition of the ' sidewalk prior to the City replacement project. We have made an investigation , � � and have contacted Mrs. Engels. Our inspector's report shows that prior to _ our construction th.e sidewalk was cracked, heaved, off grade and in need ° ' � of reconstruction. Our records further indicate that this walk was originally � constructed by a contractor by the name of H. P. Peterson, under permit date - ^ � August 19,• 1g41 . This would make the walk approximately 26 years old at the � time of our reconstruction. We are of the opinion that Mrs. Engel shoulcJ be � � � assessed in the same manner as the balance of the residents of this block. � , � The Council further directed the Department of Public Works to contact a Mr. Elmer Olson, 1095 E. Fourth Street, who complained that his new walk has ' spalled to some extent: We have made an inspection of Mr. Olson's walk and � • , �� ' � � further informed Mr. Olson that the spalled portions of his walk will be replaced,• - � � and have further informed the District Contractor that he should take .� immediate action in this regard. , ' • In reference to the complaint of Mr. Knute T. DeVahl , 1457 Edgerton Street, _' � he complained regarding the amount of walk removed and replaced. Following our - • preliminary investigatTon, we recommended removal of five panels because of . _ tree heave. On investigating this matter shortly after the hearing, we found , .
