WFIEREAS, the City of Saint Paul ("Cit}�') holds flowage rights on behalf of the Boazd of
Water Commissioners ("Board") over certain privately owned real estate within Auditor's
Subdivision No. 56, Anoka County, Minnesota, for the purpose of managing water levels of
Centerville and Peltier Lakes; and
WHEREAS, the cunent property owner, Eagie Brook Church, desires to construct a campus on
its properiy and has requested that the City release said flowage rights over certain portions of
the property in order to satisfy requirements of its title insurance issuer; and
WHEREAS, Boazd staff has evaluated the request and has determined that the Board does not
now need, and will not in the future need, the right to flood lands above elevation 887.0, and has
prepared a Release of Flowage Rights so releasing said rights over such lands; and
WHEREAS, the Boazd did adopt Resolution No. 4973 approving said Release of Flowage
Rights, authorizing execution of same, and requesting that the Honorable Council of the City of
Saint Paul likewise approve and authorize execution of said Release on behalf of the City; now,
therefore, be it
RESOLVED, that the Council of the City of Saint Paul does hereby approve said Release of
Flowage Rights over certain privately owned real estate within Auditor's Subdivision No. 56,
Anoka County, Minnesota, and does hereby authorize the proper ofFicers of the City of Saint
Paul to execute said Release on behalf of the City.

� Acting on behalf of the Boazd, the CiTy of Saint Paul sold certain surplus real estate situated immediately east of Pelrier Lake to a private
pazty. The 1901 deed of conveyance retained flowage rights in the name of the City for benefit of the Boazd. The property owner now
desires removal of these flowage rights over those portions of the property no longer needed by the Board for operation of lake water
levels.

RELEASE OF FLOWAGE RIGHTS
This Release is made and entered into this day of , 2004, by the
CITY OF ST. PAUL, a Minnesota municipal corporation ("City"), for itself and on behalf of the
Board of Water Commissioners of the City of Saint Paul (`Board").
WITNESSETH:
WHEREAS, the City reserved flowage rights over certain land located in Anoka County
described in deeds filed on Mazch 19, 1902 in Book 41 of Deeds, pages 147 and 149, and as
referred to in Document No. 287721 ("Flowage Rights); and
WHEREAS, the City reserved said Flowage Rights for benefit of the Board, which
required said Flowage Rights so that it could control the levels of Centerviile and Peltier Lakes
for management of its raw water supply; and
WHEREAS, the Board has deternvned that the reserved flowage rights are no longer
needed as to a portion of the property described in said documents;
NOW, TF3EREFORE, in consideration of $1.00 and other good and valuable
consideration, the receipt and sufficiency of which is hereby acknowledged, the City hereby
releases the property described in the attached Exhibit A from the terms of the flowage rights
reserved in said deeds.
IN WTTNESS WHEREOF, this Release has been executed as of the day and year first
above written.
