04-597Council File # �' � `� Green Sheet # 3016637 �� 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 1'7 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 Presented By RESOLUTION CITY OF SAINT PAUL, MINNESOTA Referred To � Committee: Date WHEREAS, Neighborhood Housing and Property Improvement (NHPn has requested the City Council to hold public hearings to consider the advisability of revoking the rental registration certificate for a single family rental property located at 948 4` Street East and registered to Michael Haus; and WHEREAS, on March 15, 2004, NHPI conducted an inspection of said property and issued a Correction Notice for exterior maintenance, with a compliance deadline of March 24, 2004; and WHEREAS, on Apri12, 2004, NHPI conducted a reinspection of said property and found lack of compliance with the previous order; and WHEREAS, on Apri15, 2004, NHPI sent the holder of the rental registration certificate for the subject property, Michael Haus, a$50 excessive consumption bill, addressed to 2357 Rogers Avenue, Mendota Heights, MN 55120-1421, the address on said certificate; and WHEREAS, AS OF May 12, 2004, said $50.00 has not been paid, and Legislative Code §51.06 (a) (v) provides that non-payment of fees for excessive consumption is grounds for certificate revocation; and WHEREAS, on Apri15, 2004, NIIPI notified Michael Haus of the need to arrange an interiar , inspection of the subject property; and WHEREAS, as of May 12, 2004, an interior inspection has not been arranged, and Legislative Code §51.07 (a) (iii) provides that the imposition of an excessive consumption fee is grounds for an interior inspection; and WHEREAS, on May 17, 2004, NHPI sent Michael Haus the proper Notice of Intent to Revoke Rental Registration (copy attached); and WHEREAS, Michael Haus has not appealed said notice and the time for filing an appeal has expired; now therefore BE IT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the following findings and order concerning the subject property at 948 4` Street East: 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21. 22 - o�-sa 1. That the subject pzoperty is a duplex rental property that is required to be registered wrth the City's Rental Registration Program. 2. 3 � 5. ••� � The Saint Paul City Council hereby makes the following order: 1. 2. That the holder of the Rental Registration Certificate for the subject property is Michael Haus. That said certificate holder has been billed for excessive consumption of code inspection services, which has not been paid. That said certificate holder has been requested to allow an interior inspection of the subject properiy, which has not been arranged. That the notification requirements of Chapter 51 have been fulfilled and the time for an appeal has expired without an appeal being made. The above-referenced Rental Registration Certificate issued to Michael Haus for the single fasnily rental property at 948 4"' Street, Saint Paul, MN is hereby revoked.
