WHEREAS, Pursuant to Minnesota Statutes §462.357 and §64.400 of the Legislative Code, R& N
Corporation (Saxon Ford) duly petitioned to rezone 250 & 262 Sherbume Ave. being legally described as
PIN 36-29-23-14-0110, 36-29023-13-0216, Robertson & Van Etten Addition to St. Paul ex S 8 Ft for Alley
Lot 12 Blk 28, Robertson & Van Etten Addition to St. Paul ex S 20 Ft; Lot 1 Blk 2 Chambers Addition & in Sd
Robertson & Van Etten Addition Lots 9& Lot 10 Blk 28 from RT-1 Two-family Residential to B-3 General
Business to expand the existing business and add parking, the petition having been certified by the Planning
Division on February 27, 2004, as having been consented to by at least 67 percent of the owners of the
area to be rezoned, and further having been consented to by at least two-thirds of the owners of the
property situated within 400 feet of the total contiguous property within one year preceding the date of the
petition; and
WHEREAS, the Zoning Committee of the Planning Commission held a public hearing on April 1,
2004, for the purpose of considering the rezoning petition, and pursuant to §107.03 of the Administrative
Code, submitted its recommendation to the Pianning Commission for approval; and
WHEREAS, the Planning Commission considered the rezoning petition at its meeting heid on April 9,
2004, and recommended approval to the City Council; and
WHEREAS, notice of public hearing before the City Council on said rezoning petition was duly
published in the official newspaper of the City on April 29, 2004, and notices were duly mailed to each
owner of affected property and property situated wholly or partly within 350 feet of the property sought to be
rezoned; and

WHEREAS, a public hearing before the City Council having been conducted on May 26, 2004, at which
all interested parties were given an opportunity to be heard, the Council having considered all the facts and
recommendations conceming the petition, voted to deny the rezoning for the following reasons:
1. The proposed rezoning to B-3 is in conflict with the District 7 Plan policy that supports only P-1
zoning on the south side of Sherbume,
2. The proposed business zoning does not fit in with the character of the neighborhood, and
3. Future land use problems are likely to result if the use changes from storage/parking of vehicles
and/or this property is sold separately from the rest of the Saxon Ford property. The B-3 district
allows uses that frequently generate a great deal of traffic, which would be harmful to the
residential character of the neighborhood; therefore, the Saint Paul City Council does hereby
RESOLVE, that the petition of R& N Corporation to rezone property legaliy described as Robertson &
Van Etten Addition to St. Paul ex S 8 Ft for Alley Lot 12 Blk 28, Robertson & Van Etten Addition to St. Paul,
ex S 20 Ft; Lot 1 Blk 2 Chambers Addition & in Sd Robertson & Van Etten Addition Lots 9& Lot 10 Bik 28,
commonly known as 250 & 262 Sherburne Ave., from RT-1 Two-family Residential to B-3 General Business

WHEREAS, the Zoning Committee of the Planning Commission, on April 1, 2004, held a public
hearing at which all persons present were given an opportunity to be heard pursuant to said
application in accordance with the requirements of §64.300 of the Saint Paul Legislative Code; and
WHEREAS, the Saint Paul Planning Commission, based on the evidence presented to its Zoning
Committee at the public hearing as substantially reflected in the minutes, made the fol lowing findings

1. The applicant owns Ron Saxon Ford, a large auto dealership on University Avenue. The applicant
� wishes to expand the business to the west along Sherburne, using these lots for parking of
employee cars and/or vehicles for sale. If the rezoning is approved, they will need to meet futther
zoning code requirements through site plan review and, depending on the future use of the
property, a conditional use permit.
2. The south side of Sherburne has been a transition zone for a number of years, with many
businesses along University Avenue expanding north, mainly to provide additiona] off-street
parking. 7his expansion is consistent with how the area has developed recent!y.
3. The property can be developed in a way that will not have an adverse impact on the surroundirtg
area through the site plan review process that will require buffering of the use from adjacent
residential uses.
4. The current RT-1 zoning permits low density residential uses. Given the increasing commercial
uses on University Avenue, single family and duplex development is not as reasonable a use as
the parking/outdoor auto sales uses proposed by the applicant.
5. Comprehensive Plan policies support business development and continued investment in the
University Avenue Corridor (GP16). They also support making land that has business potential

wiil consider rezonings on the south side of Sherburne on a case by case basis, but supports only
rezonings to P-1. In this case, the applicant wishes to have the flexibility to use the lots for
parking andlor oufdoor sales area. The P-1 zoning district oniy permits accessory off-street
parking of private passenger vehicles. For this reason, the applicant is requesting B-3 zoning.
The proposed use is generally consistent with the parking use supported by the bistrict 7 Plan,
but could not be restricted oniy to off-street employee or customer parking.
6. if the properfy is rezoned to B-3, a variety of commercial uses potentiaily could be located on
these lots. However, given the lack of visibility from University Avenue, the main thoroughfare, it
is unlikely that separate commercial development would occur here.
7. The consent petition was determined to be sufficient on February 27, 2004. Parcels eligible; 39;

Patricra James presented the staff report with a recommendation of approval for the Rezoning. Ms. James
stated District 12 recommends denial.
Commissioner Morton questioned whether this was spot zoning and Ms. James said it is a recommendation of
the adopted District 12 Plan, which is part of the Comprehensive Plan. If a rezoning is in conformance with
the Comprehensive Plan, it is not spot zoning. City Attorney Peter Warner stated that give that the District
�an calls for B-2, it is consistent with zoning principles and is not spot zoning.
Commissioner Kramer asked why the nonconforming use permit won't work, as suggested in letters received.
Uls. James stated it was not what the applicant applied for. She afso explained that some of the uses the
appiicant wants to put into the building would not be permitted with a nonconforming use permit.
Mahmoud Shahin, is the appficant and purchaser of the building at 1435 Cleveland Ave. N. Mr. Shahin stated
that Mr. Yahanda sold the property to him o� a contract for deed. He said there are so many names on the
petition pages he submitted because the names are people who frequent Lori's Coffee Shop, a business he
owns that is in the building. He said the petition pages show there is a need for a restaurant. Mr. Shahin
stated he would have to apply for 5 nonconforming use permits for what he wants to do to improve the bui(ding
and move uses around. He has already spent $120,000 in repairs and is planning on spending another
$80,000 to give it a face lift. it should be zoned for what it is.
No one spoke in support or opposition.
The public hearing was closed.

We would like to go on record in favor of the proposed
changes for these properties. Owning property accross
the street from a responsibie business may finally
stabalize the value of ous home.
Do not insult us with proposais for the need for
low-income housing. That is not what this block needs.
Thanks, by the way, for drug ring bust at the 256
Sherburne property, this past Sunday. W ell done. If
you could level that building as well, we'd finally be
moving in the right direction.
