The proposed rezoning to B-3 is in conflict with the District 7 Plan policy that supports only P-1 zoning on the south side of Sherbume, 2. The proposed business zoning does not fit in with the character of the neighborhood, and 3. Future land use problems are likely to result if the use changes from storage/parking of vehicles and/or this property is sold separately from the rest of the Saxon Ford property. The property can be developed in a way that will not have an adverse impact on the surroundirtg area through the site plan review process that will require buffering of the use from adjacent residential uses. 4. The current RT-1 zoning permits low density residential uses. Given the increasing commercial uses on University Avenue, single family and duplex development is not as reasonable a use as the parking/outdoor auto sales uses proposed by the applicant. 5. If a rezoning is in conformance with the Comprehensive Plan, it is not spot zoning. City Attorney Peter Warner stated that give that the District �an calls for B-2, it is consistent with zoning principles and is not spot zoning. Commissioner Kramer asked why the nonconforming use permit won't work, as suggested in letters received. Uls. James stated it was not what the applicant applied for. She afso explained that some of the uses the appiicant wants to put into the building would not be permitted with a nonconforming use permit. Mahmoud Shahin, is the appficant and purchaser of the building at 1435 Cleveland Ave. N. Mr. Shahin stated that Mr. Yahanda sold the property to him o� a contract for deed. He said there are so many names on the petition pages he submitted because the names are people who frequent Lori's Coffee Shop, a business he owns that is in the building. He said the petition pages show there is a need for a restaurant. Mr. Shahin stated he would have to apply for 5 nonconforming use permits for what he wants to do to improve the bui(ding and move uses around. He has already spent $120,000 in repairs and is planning on spending another $80,000 to give it a face lift. it should be zoned for what it is. No one spoke in support or opposition.
