2 WFiEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in
3 the City of Saint Paul; and

5 WHEREAS, §293.11 provides for the granting of variances from the sound level limitations contained in
6§293.09, upon a fmding by the City Council that fixll compliance with Chapter 293 would constitute an
7 unreasonable hazdship on an applicant, other persons or on the community; and
8
9 WHEREAS, Bymore Inc, represented by Miguel Ramos, consultant, who has been deslgnated as the
10 responsible person on the applicafion, has applied for a variance to allow live music and a DJ sound system at 857
11 Payne Ave.; and

13 WHEREAS, applicant is seeking a variance for the hours of 12:00 pm. to 6:00 p.m. June 12, 2004; and
14
15 WI3EREA5, if applicant is not granted a variance it will not be able to present a DJ or live band for their
16 anniversary celebration; and
17
18 WHEREAS, the Office of License, Inspections, and Environxnental Protection has reviewed the application
19 and has made recommendations regazding conditions for the variance; now, therefore, be it
20
21 RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to Bymore Supermercado,
22 subject to the following conditions:

24 1} The variance shall be for the hours of 12:00 pm. to 6:00 pm. for June 12, 2004

26 2) All electronically powered equipment used in conjunction with the event shall not
27 exceed 90 dBa as measured from 50 feet from the noise source

1 3} The applicant shall provide personnel and equipment who shall provide continuos
2 ' sound level monitoring between 12:00 p.m. and 6:00 p.m. on the date to ensure
3 compliance with Condition #2.

5 4) All electronically powered equipment, PA systems, loudspeakers or similaz devices shall
6 be turned off no later than 6:Q0 g.m. on June 12, 2004.
