WHEREAS, The City of Saint Paul, Minnesota desires
to undertake a comprehensive city demonstration program to
rebuild or revitalize large slum and blighted areas and
generally improve living conditions for the people who live
in such areas ; and
WHEREAS, The Secretary of Housing and Urban Development
(hereafter referred to as the "Seeretary") is authorized pur—
suant to Title I of the Demonstration Cities and Metropolitan
Development Aet of i966 to make grants to� and contract with,
City Demonstration Agencies to pay up to 80 percent of the
costs of planning and developing such comprehensive city
demonstration programs,
Now, Therefore, be it
RESOLVED� By the Council of the City of Saint Paul,
Minn.esota as follows :
Section 1. Approval is hereby granted (1) for the
submission by the Gity of Saint Paul, Minnesota of a request
for financial assistance for the plan.ning and development of
a comprehensive city demonstration program; (2) for the pro—
"+'� vision of any information or documentation concerning the
� � preparation and content of such program as may be required
:� �,�� by the Secretary; and (3) for the representation by the
� n Honorable Thomas R. Byrne, Mayor of the Gity of Saint Paul,

NSection 2. The City of Saint Paul, Minnesota hereby

of, or be subjected to discrimination in the undertaking of
any of the projects or activities assisted under Title I of
the Demonstration Cities and Metropolitan Development Act
of 1g66.
Section 3. The Honorable Thomas R. Byrne, Mayor of
the City of Saint Paul, Minnesota, is hereby authorized to
execute said proposed Contract in three counterparts, and the
Honorable Thomas R. Byrne, Mayor of the City of Saint Paul,
Minnesota, is hereby authorized and directed to impress and
attest the official seal on each such counterpart and to for-
ward such counterparts to the Secretary for execution on
behalf of the Government, together with such other documents
relative to the approval and execution thereof, as well as
to this Resolution, as may be required by the Govern.ment.
Section 4. The Honorable Thomas R. Byrne, Mayor of
the City of Saint Pau�, Minnesota, or his lawful successor,
is hereby authorized to file requisitions� together with
necessary supporting documents, with the Government, from
time to time as grant f�nds are required� requesting payments
to be made on account of the grant provided for in the said
Gontract, and to do and perform all other things and acts
required to be done or performed in order to obtain such
payments .
Section 5. The City of Saint Paul� Minnesota.:hereby
gives its assurance that the necessary non-Fecleral share of
the cost of the planning activities, not to exceed �53,695,
undertaken pursuant to its application as modified and the
grant contract, will be duly provided.

Gentlemen:
You have asked for my opinion as Corporation Counsel for
the City of Saint Paul , Minnesota, on several questions presented
by the Department of Housing and Urban Development in connection
with your application to be filed with the Department on or about
April 15, 1968 for a grant under Title I of the Demonstration
Cities and Metropolitan Development Act of 1966 for the planning
and developing of a comprehensive city demonstration program.
I have examined your application and have also reviewed
all pertinent Federal , State , and local laws . Based upon the
�oregoing, it is my opinion that :
(1 ) The City of Saint Paul , Minnesota is a properly and
validly created public body.
(2) The filing of the application has been approved
by the governing body of the city by resolution,
Council File No . 238046, dated April 11, 1968,
and this resolution is the only such resolution
pertaining to the application or its subject matter.
(3) The City of Saint Paul, Minnesota, possesses the
authority, under State and local law, including,
but not limited to , Minnesota Statutes 462. 351
et seq. and Minnesota Statutes 462. 581 et seq. ,
the Charter of the City of Saint Paul , Chapter
VIII, and in particular Sections 126 and 12�
thereof, and Chapter XIII, to undertake the
overall planning and administration of the program
including (1) the authority to provide the local
share of the costs ; (2) the power to contract with
the Federal Government and receive and expend
Federal funds ; and (3) the authority to adopt
the administrative structure set forth in Part V
of the application, in furtherance of purposes
set forth in the Demonstration Cities and
Metropolitan Development Act of 1g66.

(4) The City of Saint Paul, Minneaota, possesses
adequate authority under State and local law to
permit fulfillment of the Federal laws w�h
respect to relocation, wage and labor standards,
and the prohibitions against discrimination
on account of race , color, crc�ed or national

Federal financial assistance. (Sections 107
and 110 of the Demonstration Cities and Metropolitan
Development Act of ig66, 80 Stat. 1259, 42 U. S.C.
53307, 3310 (1967) ; Contract Work Hours Standard
Act, 76 Stat. 357 (1g67) , 40 U.S.C. 5327 (1g66) ;

WHEREAS, the City of Saint Paul, Minnesota is making application to the
Department of Housing and Urban De���lopment for a money grant to plan a
comprehensive model cities prooran� under Title I of the Demonstration Cities
and rietropolitan Development Act �f 196b in the area of the Summit-University
Urban�Renewal Project rlinn. R=47 being planned by the Housing and Redevelopment
Authority of the City of Saint Paul, Minnesota; and
WH�REAS, a model cities program for the Summit-University Area �aill directly
affect the planning of the urban rene�aal redevelopment project and aid in its
execution throuoh Federal financial assistance towards the cost of the project
and by a comprehensive pro�ram to rebuild and revitalize the physical conditions
