04-552Council File # �, a � Resolution # Green Sheet # � � 2 Presented By Referred To RESQLUTIOtV CITY OF SAINT PAUL, MINNESOTA 3Z Committee: Date WHEREAS, Chapter 293 of the Saint Paul L,egislative Code was enacted to regulate the subject of noise in the City of Saint Paul; and 0 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 WHEREAS, §293.11 provides for the granring of variances from the sound level limitarions contained in §293.09, upon a finding by the City Council that full compliance with Chapter 293 would constitute an unreasonable hardship on an applicant, other persons ar on the community; and WHEREAS, Cazl Bolander & Sons Company, represented by Jeff Fye, Project Manager, who has been desi�ated as the responsible person on the application, has applied for a variance to allow construction wark to take place for a Saint Paul pedestrian/bike trail and tunnel under the Burlington Northern and Santa Fe Railroad tracks at the intersecfion of Lexington Parkway N. and Jessamine Ave. and the project will be using off road construction equipment; such as excavators, loaders, cranes and light plants; and WHEREAS, applicant is seeking a variance for the days of May 29 through June 1, 2004; and WHEREAS, if applicant is not granted a variance it will not be able to perform the necessary construction wark in a rimely manner, and the completion date would be extended, causing increased costs and inconvenience to the public as the work has to be done at the Burlington Northern and Santa Fe Railroad's convenience, therefore requiring the work to take place on a holiday weekend; and WHEREAS, the Office of License, Inspections, and Environmental Protecrion has reviewed the applicarion and has made recommendations regarding conditions for the variance; now, therefore, be it RESOLVED, that the Council of the City of Saint Paul hereby grants a variance for Carl Bolander & Sons Company, to permit construction work for a Saint Paul pedestrian/bike trail and tunnel under the Burlington Northern and Santa Fe Railroad bridge at the intersecrion of Lexington Parkway N. and Jessamine Ave, subject to the following condirions: 1) The variance shall be for the days of May 29 through June 1, 2004 i 2) Cazl Bolander & Sons Company shali take all practi steps available to minimize the 3 costs of the project. 4 5 6 7 8 9 �� 13 14 15 16 17 18 19 2� 21 22 23 Adopted by Council: 24 25 Adoption Certified by Council Secretary 26 � 28 BY � �ii/4 Ci/�i�so'`t, 3� Approved Mayor: Date ��� 31 �✓�Z� i✓t-C 32 33 sy: k��Z��� 34 or unreasonably increasethe 0�1- `.�Z Requested by Department of: Office of License, Inspections and Environmental Protection By: �� l7 ���-S.C.�-� Janeen E.
