WHEREAS, A certain lease agreement was entered into on
the fifth day of April, 1922, between the Chicago, St. Paul,
Minneapolis & Omaha Railway Company, the Chicago, Milwaukee &
St. Paul Railway Company, and the City of Saint Paul, said lease
agreemen.t pertaining to the westerly fourteen feet of the right—
of—way of the railroads between Ja.mes and Cascade Streets in the
City of Saint Paul, Minnesota, except that part thereof leased to
Thomas Bartyzal and occupied by his shed on Lot 12, Block 28,
Subdivision. of Blocks 28 and 29, Stinson, Brown & Ramsey' s
Addition to St. Paul; and
WHEREAS, The said lease was for a term of five (5) years,
however, subjeet to termination thereafter upon one year' s written
notice in writing to the other parties, and it is the opinion of
the Department of Public 'Works that there is no longer public need
and necessity for this driveway easement; now, therefore, be it
RESOLVED, That the proper City officers are hereby authorized
and direeted to execute, on behalf of the City of Saint Paul,
termination rider agreement terminating the said lease agreement
between the Chicago, St. Paul, Minneapolis & Omaha Railway Company,
the Chicago, Milwaukee & St. Paul Railway Compax3.y, and the City of
Saint Paul dated April 5, Ig22, said termination to be effective
November 1, 1967, a copy of said termination rider being attached
hereto and incorporated herein by reference.

Dear Mr. Donovan:
A lease between the City of St. Paul and the Chtcago, St. Paul ,
Minneapolis and Omaha Railway Company under C.F. No.39167, for the use
as a driveway, on the westerly 14 feet of said railway right-of-way
between Cascade Street now Palace Avenue, and James Avenue was executed
and approved on April 15, 1922.
The �epartment of Public Works grading, paving,, sewer, traffic and
maintenance engineers have all concurred that this driveway is now not
necessary.
It is therefore my recorrnnendation that it now appears that the seid
lease be cancel !ed.
Attached hereto are two prints showing the subject westerly 14 feet
shaded in red.

Dear Sir:
I have reviewed your letter of March 20, 1968, including
the attached lease agreement dated April 5, 1922, between the above
parties ; letter of H. J. Goldberg, Office Engineer, Department of
Public Works , dated March 5, 1968; and proposed termination rider
executed by the Chicago and North Western Railway Company and the
Chicago , Milwaukee, St. Paul and Pacific Railway Company.
Attached please find resolution approved as to form by me
authorizing execution of termination rider on behalf of the City of
Saint Paul . The termination rider should be signed by the Mayor,
the Commissioner of Public Works , countersigned by the Comptroller
and attested to by the City Clerk. I also recommend that the letter
of Mr. Goldberg be attached to the resolution and that the Commission-
er of Public Works be the proper party to introduce the same to the
City Council.
I herewith transmit to you said resolution, original letter
addressed to you and signed by H. J. Goldberg dated March 5, 1968,
two copies of drawing showing location of the subject lease premises ,
original letter addressed to you and signed by A. F. Mason, Senior
Lease Agent , Chicago and North Western Railway dated March 15, 1968,
and original and two copies of termination rider executed by the
Chicago and North Western Railway and the Chicago, Milwaukee, St.
Paul and Pacific Railway.
