WHEREAS, on March 2Q 2004, this deparhnent conducted an inspection of said property and
issued a correction order for vehicles, with a compliance deadline of Mazch 2, 2004; and
WHEREAS, On Mazch 4, 2004, this departxnent conducted a reinspection of said property and
granted an extension with a compliance date of March 10, 2004; and
WHEREAS, on March 11, 2004, this department conducted a reinspection of said property and
found lack of compliance with the previous order.
WHEREAS, on March 16, 2004, NHPI sent the holder of the rental registration certificate for the
subject property, Luther L. Whitehead a$50.00 excessive consumption bill, addressed to 467 St.
Anthony Avenue; St. Paul, MN 55103-2207, the address on said certificate; and
WHEREAS, as of Apri126, 2004, said $50.00 has not been paid, and Legislative Code §51.06 (a)
(v) provides that non-payment of fees far excessive consumption is grounds for certificate revocation;
and
WHEREAS, on March 16, 2004, NHPI notified Luther L. Whitehead of the need to arrange an
interior inspection of the subject property; and
WHEREAS, as Apri126, 2004, an interior inspection has not been arranged, and Legislative
Code §51.07 (a) (iii) provides that the imposition of an excessive consumption fee is grounds for an
interior inspection; and
WHEREAS, on Apri126, 2004, NHPI sent Luther L. Whitehead the proper Notice of Intent to
Revoke Rental Registration (copy attached); and
WHEREAS, Luther L. Whitehead had not appealed said notice and the time for filing an appeal
has expired; now therefore
BE IT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the
following findings and order concerning the subj ect property at 711 St. Anthony Avenue:

with the City's Rental Registrarion Program.
That the holder of the Rental Registration Certificate for the subject properry is Luther L.
Whitehead.
That said certificate holder has been billed for excessive consumption of code inspection
services, which has not been paid.
That said certificate holder has been requested to allow an interior inspection of the
subject property, which has not been arranged.
That the notification requirements of Chapter 51 have been fulfilled and the time for an
appeal has expired without an appeal being made.

The Saint Paul City Council hereby makes the following order:

The above-referenced Rental Registration Certificate issued to Luther L. Whitehead for
the single family property 711 St. Anthony, Saint Paul, MN is hereby revoked.
It is further ardered that a copy of this resolution be mailed to Luther L. Whitehead.

Dear Luther Whitehead:
I am writing to you in your capacity as the holder of a rental registration certificate for 711 St. Anthony
Avenue, St. Paui MN.
You are hereby notified, pursuant to the aut$ority granted to me under Chapter 51 of the St. Paul Legislative
Code, of the City's intent to revoke the registration certificate for 711 St. Anthony Avenue based on the
following:
On February 2Q 2004, this department conducted an inspection of said property and issued a
correction order for vehicles, with a compliance deadiine ofMarch l, 2004.

Once the City Council has revoked the rentai registration certificate, occupaacy of the property is not allowed
until (1) an inspection by Nei�hborhood Housing and Property Improvement (NFIPn has been conducted, (2)
the Director of NHPI has determined the property to be in compliance, and (3) the certificate is renewed. Note:
Renting a property without a certificate is a misdemeanor.
Please call me as soon as possible to arran�e a meetin� to discuss how to correct this situation before the City
Council acts to revoke this certificate. If all issues are addressed, I will recommend that the revocation be
withdrawn from consideration by the City Council.
