2 WHEREAS, the recent opening of an apparent "adult use" business in Wazd 4
3 underscores the need to undertake a study of the City's zoning ordinances regulating various
4 "aduit" uses; and

6 WHEREAS, the Council of the City of Saint Paul desires that present City zoning
7 ordinances regulating such uses be reexamined for efficacy; and
8
9 WHEREAS, pending the return of such a study, the Council desares that the present status
10 quo regarding any "adult" use in the 4�i be maintained; NOW, THEREFORE,

BE TT RESOLUED, that the City undertake a study of its present "adult use" ordinances;
�
BE IT F'CJRTHER RESOLVED that because the said study may lead to the adoption of
amendments to the City's official zoning controls regarding "adult" uses, the obvious need to
preserve the status quo with respect to land use and to protect the general health, welfaze and
safety of the public pending the conclusion of the said study, there shall be an immediate but
temporary prohibition on establishment, expansion or relocation of any of the "adulY' uses
defined in the zoning ordinances, on any parcel of land or part thereof within the �-�- of Saint
�x''�'-^°'"^°°'�^..�a^�°° °r° °°"�°,°_°, until such time as the aforementioned study has beeh P a� -
completed and the Council of the City of Saint Paui has taken action on the recommendations
contained therein; and
BE TT FURTHER RESOLVED, that the prohibition contemplated shall be by separate
ordinance, as provided in Minn. Stat. § 462355, Subd.(4), which shall prohibit on any pazcel of
land or part thereof within,�e� aint �u�e issuance or approval of zoning and
building pernuts, plat app� for the establishment or expansion of any
"adult" use, untii the expiration of twelve month or until such earlier time as the Council has
taken action on the recommendations contained in the study; and,
BE TT FiJRTHER RESOLVED, that pending tbe adoption of the interim ordinance
prohibiting any development inconsistent with the pending study and any amendments to the
City's official controls within the boundaries of the described areas, no zoning or building
pernuts, plat approvals or lot splits may be issued or approved for the establishment or expansion
of any "adult" use, from this date and until the expiration of twelve months as allowed by Minn.
Stat. § 462355, Subd.(4), or until such earlier time as the Council of the City of Saint Paul has
taken action on the recommendations contained in the study; and,

2 the Council has reviewed its recommendations for possibie adoption, city departments receiving
3 written applications for the approvals noted above shall accept the applications and immediately
4 process them in accordance with the provisions of Minn. Stat. § 15.99, Subd. 2 and with the
5 intent of this interim ordinance; and

7 BE TT FTNALLY RESOLVED, that the restrictions contained in this resolution and in the
8 said interim ordinance may be extended by action of the Council of the City of Saint Paul for
9 those additional time periods not to exceed the time provided in Minn. Stat. § 462355, Subd. (4)
10 in the event such study and recommendations and the deliberations of the Council require such
11 extensions of time.
