Dear Sir: - I have examined the proposed cooperation agreement for Concord Terrace Urban Rene��ral Area, Project R-37 , and t,�as under the impression that Section 2, Part B, required that the City of Saint Paul would demolish a number of buildings for the Housing and Redevelopment Authority. Section 2, Part B, specifi- cally provides that the City will provide as a non-cash. grant- in-aid to the project deinolition and removal work set out in Exhibit B and that the City was required to have all of the demolition and removal work completed no later than September 30, 1972. In talking with Mr. McAuliffe, your Assistant Staf� Counsel, I am now informed that the intent is for the City of Saint Paul to provide the funds for the demolition and removal work, said funds to be derived from_ City Urban Renewal Bond Funds and that the actual demolition and removal work will be performed by the Housing and Redevelopment Authority. It appears to me that Section 2, Part B, should be changed to more accurately state what the City of Saint Paul agrees to do as its local grant-in-aid. I believe that in previous agreements where the City is to provide cash as its 1`bcal share that the eooperation agreeu�ents made reference to the City agreeing to provide funds from Urban Rene�lal Bonds to be used for a project, and the project to be performed by the Housing anc� Redevelopment Authority with the said funds . R-37 THIS AGREEMENT by and between the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota (herein called the "Authority") and the City of Saint Paul, Minnesota (herein called the "City") , WITNESSETH: w WHEREAS, the Authority, a public body corporate and politic, duly created and functioning under the laws of the State of Minnesota, is undertaking an urban renewal project known as the Concord Terrace Urban Renewal Area Project Minn. R-37 (herein called the "Project"), located in the area (herein called the "Project Area") , described : in Exhibit "A" hereto attached and made a part hereof; WHEREAS, the Project involves the acquisition by the Authority, the clearance and the disposition for redevelopment, of property in the Project Area and the pro- vision of streets, utilities and other site improvements essential for the prepera- tion of the land for its reuse in accordance with a redevelopment plan as prepared by the Authority and approved by resolution of the City CF No. 237700 , on March 22 , 1968, ; , WHEREAS, the slums and conditions of deterioration and blight existing in the Project Area constitute a menace to the community and are detrimental to the health, safety, morals and welfare of the residents of the community and the state; and the elimination of said slums and conditions of deterioration and blight by the Author- ity with federal financial assistance provided pursuant to Title I of the Housing Act of 1949, as amended, including the acquisition, clearance and disposition of ' 1a nd in the Project Area for redevelopment by private enterprise in conformity with the redevelopment plan therefor, is necessary for the protection and preservation of the public health, safety, morals and welfare, and that the carrying out of the Project is in the public interest ; WHEREAS, it is required under said Title I of the Housing Act of 1949, as , amended, that the Federal contract for capital grant assistance for the Project between the Federal Government and the Authority require the provisions of local grants-in-sid in connection with the Project which locel grants-in-aid shall con- aist of either, or a combination of: (1) cash grants; (2) donations of land; (3) -1- w � � � w t t ' ( � � � � � demolition or removal work or site improvements in the Project Area; or (4) the provision of parks, playgrounds, and public buildings or facilities which benefit the Project; WHEREAS, it is necessary and in the sound interest of the community and o�herwise beneficial and advantageous for the City to cooperate with the Authority in carrying out the Project to the end that deleterious conditi.ons in the Project Area be removed and that the Project Area be redeveloped in accordance with sound practical planning objectives, which redevelopment will contribute materially to the well-being, progress and development of the community as a whole; WHEREAS, in order to carry out the Project and qualify for federal financial assistance, it is essential that the City provide certain local grants-in-aid as herein specified to the end that the Authority may receive the said assistance , which is essential for effectuating the Project and in order to carry out the plans and objectives of the community; WHEREAS, upon the basis of reasonable estimates of cost prepared by the Authority, it appears that the net project cost to be incurred by the Authority, constituting the difference between the gross cost of the �project and the pr oceeds derived from the disposition of the land or other property sold by the Authority, amounts to approximately $9,571,213, of which amount approximately $3,389,182 has been allowed as a credit to the project for local grants-in-aid. This credit is based upon local grants-in-sid expenditures of $3,506,100. The Federal Government ia expected to provide to the Authority approximately $4,896,168 in the form of a Capital Grant, or �the difference between the net project cost and the credit to be obtained from local grants-in-aid. WHEREAS, under Section 35 of the Minnesota State Housing Act of 1947, as amended, (M.S.A. 462.581) the City is duly authorized to cooperate with the Authority in carrying out the Project and is empowered to enter into this Agreement and otherwise provide the local grants-in-aid herein specified. NOW, THEREFORE, in consideration of the mutual benefits and advantages herein provided for, and of the mutual covenants and promises hereinafter set forth, the Authority and the City do hereby agree as follows: 1.
