RESOLVED, that the Bitnmiuous Contractor License held by Gary Oster, d/b/a Daily &
Son Blacktopping, Inc., located at 1900 Fourth Avenue, Newport, MN, doing business in the City
of Saint Paul, License ID#0066307, is hereby suspended immediately for failure to pay
delinquent license fees and late chazges. The licensee must also submit a current bond. Said
suspension shall remain in effect until such time as all license fees and any late chazges or
penalties have been paid in full, the licensee has submitted a current bond and written notice of
the lifting of said suspension has been provided to the licensee by the Office of License,
Inspections and Environxnental Protection.
This Resolution and the action taken above are based upon the facts contained in the
December 3, 2003 Notice of Violation letter to the licensee. The licensee did not contest the
facts of the violarion.

for the City of Saint Paul
License ID #: 0066307
Dear Mr. Oster:
The Office of License Inspections and Environmental Protection (LIEP) has
recommended adverse action against the above-referenced license. The basis for the
recommendation is as follows:
On October 20, 2003, you were sent a letter from the Office of
LIEP indicating that your license had expired and that license
fees were due. You were given until October 31, 2003 to
submit the fees but as of today's date, nothing has been
received, nor have you indicated that you no longer wish to do
business in Saint Paul. The letter incorrectly noted the type of
license you hold, but correctly identified the license fees and
late charges now due. You must also submit a current bond.
The Office of LIEP will recommend the suspension of your licenses until fees have been paid.
At this time you have three options on how to proceed:
If you do not dispute the above facts and wish to avoid further adverse action, you must
submit the required fees and late charges, and bond information to the Office of LIEP,
Room 300 Lowry Professional Building, 350 Saint Peter Street, Saint Paul, Minnesota
55102, no later than Friday, December 12, 2003. The information should be directed to
the attention of Ms. Christine Rozek.

2. If you do dispute the above facts, and believe that payment has been made, you can either
show proof of the payment, or request a hearing, which will be scheduled before an
Administrative Law Judge. At that hearing both you and the City will be able to appear
and present witnesses, evidence, and cross-examine the other s witnesses. The St. Paui
City Council will uitimately decide the case.
3. If you wish to cease doing business in Saint Paui you can send a letter to the Office of
LIEP indicating your intention to withdraw your license.
If you have not contacted me by December 12, 2003, I will assume that you are not contesting the
facts and will schedule this matter for a hearing before the City Council for a consent agenda, at
which time your license will be suspended until such time as the fees are paid and the
information is submitted.
