This property is further described as the west 160' of Lots 5 and 6, Hudson Road Gardens. The applicant proposes to develop the property with a 33-unit apartment building. This matter _was considered at the January 18, 1968 Board of Zoning meeting. The staff reported that the existing zoning is primarily "A" Residence with the site in question and a small area to the south zoned "C" Residence. Areas loc,ated one block to the west and one block to the east are zoned Commercial. Existina development consists of two large mot�ls to the south, scattered single-family houses to the east and west, and vacant land to the north. N�w filling stations are located on t;ze northeast and northwest corners of White Bear Avenue and Old Hudson Road. The property has an area of 33,562 square feet which is 338 square feet (.98%) short of the required area for a 33-unit apartment building. The proposed setbacks are 10' from Van Dyke Street and 30' from Old Hudson Road. The site is part of two large lots for which the setback requirements are based on a percentage of the lot depth. As determined by the lot depth, the required setback from Old Hudson Road would be 42' . In regards to the relaxation of density standards, it was the findings of the board that the less than lo shorta�e of the required area is insignif�;�ant. In regards to the relaxation of the setback requirement, the existing houses in the area are along Old Hudson Road and set back some 20' to 25' . Therefore, a 30' setback from Old Hudson Road would seem reasonable. Therefore, the Board of Zoning recommends approval of both the appeal to relax the density standards to allow a 33-unit structure and the appeal to relax the setback standards to 10' along Van Dyke Street and 30' along Old Hudson Road.
