04-503___ Council File#_!� - �� Green Sheet # �� RESOLUTION OF SAINT PAUL, MINNESOTA �"� � Presented By Referred To Committee: Date 1 WF3EREAS, Section 86.03 (b)(3) of the Saint Paul Administrative Code states that the 2 "lease of park lands and/or recreation facilities for a period of more than five (5) years where the 3 property will no longer be exclusively for the use of the public shall, without limiting the 4 provisions of chapter 13 of the City Charter, be considered a diversion or disposal subject to the 5 provisions of section 13A1.01 of the City Charter"; and 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 WHEREAS, the City and Neighborhood House have entered into a cooperative partnership to construct a new facility on the site of the current El Rio Vista recreation center, to be known as the Paul and Sheila Wellstone Center for Community Building; and WHEREAS, the parties intend to enter into a long-term lease of the facility, subject to the City's right to the exciusive use of the portion of the building to be used as parks and recreation space;and WHEREAS, the new facility will be lazger than the existing recreational center, and will provide additional space for pazks and recreation programming, and will continue the provision of social services by Neighborhood House from the new facility; and WHEREAS, the I.ease and Operating Agreement will not include the lease of any of the outdoor recreational lands, nor will there be any net loss of recreaUonal space within the building; and WHEREAS, pursuant to Chapter 13.01.01 of the City Charter, parkland shall not diverted to other uses or disposed of except in accordance with the provisions listed therein, which includes a review of the proposal by the Saint Paul Parks Commission, which then submits its recommendation to the city council, and a public hearing to be conducted by the city council for the purpose of considering the proposal and the recommendation; and WIIEREAS, the Saint Paul Parks Commission has reviewed the Project and has recommended its approval of moving forward with the construction and long term lease to NH; and WHEREAS, notice of the public hearing was published at least 10 warking days prior to the hearing in the legal newspaper; and WI�REAS, the City Council finds that the construction of the new Paul and Sheila Wellstone Center for Community Building and its ]ong term lease to Neighborhood House, subject to the City's right to exclusive use of the parks and recreation space will not result in the loss of park land; now, therefore be it 1 RESOLVED, that the City Council finds that the construction of the_new�?auland-She�l�� — 2 Wellstone Center for Community Building and its long term lease to Neighborhood House, 3 subject to the City's right to exclusive use of the parks and recreation space, is in the best 4 interests of the public, and further finds that there because there is no loss of park land, that no 5 additional park lands need be acquired to replace those lands diverted or disposed. ._ o� '_ � Green Sheet Green Sheet Green Sheet Greerr Sheet Green freen - DepartmeMloffice/council: Date IniEated: p -����,a�� 30.APR-04 Green Sheet NO: 3015877 � CoMact Person 8 Phone: ���^t Sent To Person InitiaVDate Bob BieSCheid � 0 ar an Rec " 2 A55ign 1 arla and Recreation D artme t Dir r.� �� Must Be on Council qqenda by (Date): Number 2 � p��, .
