according to the plat on file and of
record in the office of the Register of
Deeds in and for the Coun.ty of Ramsey,
State of Minnesota.
WHEREAS, Pursuant to resolution, C. F. 236088, approved
December 12, 1967, a public hearin.g was duly held on Tuesday,
December 26, 1967, and also on Tuesday, February 27, 1g68,
before the Council of the City of Saint Paul, said hearing
pertaining to the condition of the structures located at 906
Iglehart Avenue, Saint Paul, Min.nesota; and
WI�REAS, Upon the facts presented at the said hearing
consisting of photographs , inspection reports and the recommenda-
tion of the City Architect, it is found and determined by the
City Council that according to the records and files in the
office of the Register of Deeds, the last record owner of the
above-described property is Elmer H. Justus; that Twin City
Federal Savings and Loan Association is the mortgagee and
purchaser at the mortgage foreclosure sale held on. April 25,
1967; that North Shore State Bank is the mortgagee; that Paul
H. Ray is the apparent unrecorded fee owner; that Thomas J.
Burke is an interested party; that according to the records
of the Ramsey Goun.ty Probate Court Elmer H. Justus is deceased;
and that there are no other lien holders of record; and that
it is further determined that the above—described building
constitutes a hazardous building within the definition of
Minnesota Statutes Section 463. 15 for the following reasons:

a. The building is standing vacant ,
apparently abandoned and is subject to entry
by unauthorized persons;
b. The exterior condition of the building
is as follows: the asbestos residing materials
are broken off and missing, mortar joints
between the bricks and chimney are eroded,
window sills and frames are rotted, windows are
broken, the roofing is in poor condition, the
outside concrete basement stairway and the
front entrance steps are deteriorated and in
need of repair;
c. The interior of the building has been
extensively vandalized, plumbing fixtures- have
been removed and broken; there is an open sewer
connection in the bathroom which permits the
entrance of rodents into the building;
d. The detached garage is dilapidated,
the siding is rotted, the roof sags, cornice
boards are rotting, roof shingles missing, and
the garage is standing open;
e. The dwelling in its present condition
is unfit for human habitation ; and in order to
make the same habitable, it must be repaired
and corrected so as to comply with the Saint Paul
Housing Code and the Saint Paul Building Code
requirements ;
f. The building and detached garage are
beyond reasonable repair;
g. The building and detached garage con-
stitute a nuisance and a hazard to the public
health, safety and welfare because of its
physical damage, dilapidation, abandonment and
inadequate maintenance;

now, therefore, be it
RESOLVED, That in accordance with Minnesota Statutes
Sections 463. 15 through 463. 26, and based upon the foregoing
findings of the City Council, the Council of the City of
Saint Paul does hereby make the following Order:
ORDER
1. The owner of the above-described building and
accessory building shall make the same safe and not detri-
mental to the public health, safety and welfare by having the
said buildings razed and the materials therefrom removed from
the premises within thirty (30) days from the date of the
service of this Order or, in the alternative, begin to correct
the hazardous conditions within thirty (30) days from the date
of the service of this Order to correct the hazardous conditions
by doing the following:
a. Remove all paper and other combustible
materials from the buildings and securely close
and keep closed all doors , windows or other
openings in the building;
b. If the building is to be used for
human habitation, all of the above defective con-
ditions must be corrected and the building
corrected so as to comply with and meet the
Saint Paul Housing Code and the Saint Paul .
Building Code requirements, and that the
owner submit a list of intended corrections
regarding the structural condition of the
building, electrical and heating system,
together with a schedule for the completion of
the rehabilitation program and that the owner
apply for the necessary permits in the office
of the City Architect within the thirty (30)
days imposed herein.

2. Unless such corrective action is taken to comply with
this Order or an answer served upon the City of Saint Paul and
filed in the Office of the Clerk of the District Court of
Ramsey County, Minnesota, within twenty (20) days from the date
of the service of this Order, a Motion for Summary Enforcement
of this Order to raze and remove the said buildings will be
made to the Ramsey County District Court.
3. In the event that the buildings are to be razed by
the Ci�y of Saint Paul pursuant to judgment of the District
Court, all personal property or fixtures which may unreasonably
interfere with the razing and removal of these buildings shall
be removed within ten (10) days from the entry of judgment; and
if not so removed, the City of Saint Paul shall remove and
dispose of such personal property and fixtures as provided by
law.
4. If the Gity of Saint Paul is compelled to take any
corrective action herein, all necessary costs expended by the
City will be assessed against the above—described real estate
and collected as other taxes; be it
FURTHER RESOLVED, That a certified copy of this resolution
and incorporated Order herein be served upon the last record
own.er of the above—described property in the manner provided
by law and also upon other interested parties in the manner
provided by law.

Gentlemen:
The Building Department is hereby submitting its report on the condition
of the property known as 906 Iglehart Ave. a two family dwelling and a
detached garage. The owner of record is Elmer H. Justus and the following
appear to have an interest: Twin City Federal Savings & Loan, North Shore
State Bank, Thoma.s J. Burke and Paul and Gertrude Ray.
The legal description of the property is Lot 5, Block 2, Fairbanks Addition
to the City of Saint Paul.
A recent inspection indicates the property consists of a two family residence
of frame construction, two stories in height, approximately 22 feet wide,
50 feet long and 28 feet in height, and a frame garage 16 feet x 18 feet.
EXTERIOR
Some of the asbestos residing materials have been broken off and are missing,
exposing some of the wood sub-sheeting. The mortar joints between the bricks
and the chimney have eroded, causing the bricks to be loose. The window sills
are rotted, as are the window frames. Most of the windows have been broken
by vandalism. The roofing is in very poor condition. The gutters are damaged
and have some of the rain leaders missing. An outside concrete basement stairway
has deteriorated. The front entrance steps have concrete caps which are loose
on either side.
INTERIOR
The interior of the building has been extensively vandalized, especially the
first floor bathroom, which has had the lavatory and stool removed and smashed
leaving an open sewer connection to the bathroom which could allow the entrance
of rodents into the building.

GARAGE
The garage is of frame construction. It has the siding rotted, the roof is
badly sagged, the cornice boards are rotting and some of the roof shingles
are missing. The service door has rotted, the roof boards are rotting and
the walls are bulging. The garage building apparently has never been painted
nor completely finished. There are holes where the siding material is missing.
The overhead garage door is broken.
On August 3, 1967 this department gave notice to all the parties having an
apparent interest in the property that the buildings must be secured. The building
had been secured, however, the garage building at the rear is still standing
open.
If it is the opinion of the owners of this property that it can be rehabilitated,
it will be necessary that they submit the list of corrections which they propose
regarding the structural condition of the building, as well as the electrical,
plumbing and heating systems, with a schedule for the completion of the
rehabilitation Qrogram, along with the application for permits.
If the foregoing schedule is not submitted by the owners, it is the conclusion
of the Bureau of Public Buildings that by reason of inadequate maintenance,
dilapidation, physical damage, unsanitary condition and abandonment, the above
structures constitute a hazard to public health, safety and welfare. It is the
further recotmnendation of the City Architect that the Council concur in this
conclusion and refer the matter to the City Attorney's office for submission
of this condemnation to the District Court.
