COUNCIL RE OLUTION—GENERAL FORM PRESENTED BY COMMISSIONE DATF In the Matter of a hazardous building and accessory building being that one and one—half story frame duplex and partial basement known and described as 421 �T�.�d��ho1'��-�: Street in the City of Saint Paul and situated upon those premises legally described as Lot 4 in the North %2 of Block 15, Stinson, Brown and Ramsey' s addition to St. Paul, according to the plat on file and of record in the office of the Register of Deeds in and for the County of Ramsey, State of Min.nesota. WHEREAS, Pursuant to resolution, C. F. 236g61, approved February 2, 1968, a public hearing was duly held on Tuesday, February 20, 1968, before the Council of the City of Saint Paul, said hearing pertaining to the condition of the structures located at 421 ]'�����r���� Street, Saint Paul, Minnesota; and WI�REAS, Upon the facts presented at the said hearing consisting of photographs, inspection reports and the recommenda— tion of the City Architect, it is found and determined by the City Gouncil that according to the records and files in the office of the Register of Deeds, the last record owners of the above—described property are Peter E. Mickelson and Elsa E. The buildings are vacant, open and subject to entry by unauthorized persons; b. The exterior condition of the pro- perty is as follows: The asphalt siding is falling from the outside walls, the roofing ma�rial is in poor condition with some of the shingle tabs broken, the two chimneys are dilapidated and bricks are loose and falling, the front porch,�decking is rotted and loose, a rear stairway to the second floor exterior has been badly damaged with the section of the railing on the platform completely broken off and the handrail broken, the roof structure in the rear has collapsed, and all of the �.Adm�� are broken and the sashes damaged beyond repair; c. The interior of the building has been extensively damaged by vandals, the plaster is badly cracked, flooring is sagging; d. The accessory building in the rear of �he property is in an advanced state of dilapd.a- tion and is beyond reasonable repair; e. The building and aecessory building in the above condition is beyond reasonable repair; f. The building and accessory building constitute a nuisance and a hazard to the public health, safety and welfare because of its physical damage, dilapidation, abandonment and inadequa�e maintenance; now, therefore, be it • � . �������� Page 3. RESOLVED, That in accordance with Minnesota Statutes Sections 463. 15 through 463. 26, and based upon the foregoing findings of the City Council, the Council of the City of Saint Paul does hereby make the following Order: ORDER 1. The owners of the above-described building and accessory building shall make the same safe and not detrimental to the public health, safety and welfare by having the building and accessory building razed and the materials therefrom removed from the premises within thirty (30) days from the date of the service of this Order or, in the alternative, begin to correct �he. b��� nus -c�.ralitions and correct the hazardous conditions by doing the following: a. Remove all paper and other combustible materials from the buildin�,sand securely close and keep closed all doors , windows and other openings in the building and aecessory building; b. Wreck and remove the hazardous access- ory building; c. If the building is to be used for human habitation, all of the above defective conditions must be corrected and the wiring, plumbing an.d heating systems brought up to comply with the Housing Code and Building Code of the City of Saint Paul , and further that the owners submit a list of intended corrections regarding the structural condition o� the building, electrical and heating system, together with a schedule for the completion of the rehabilitation program; and further that the owners apply for the necessary permits in the office of the City Architect within the thirty (30) days imposed herein. Unless such corrective action is taken to comply with this Order or an answer served upon the City of Saint Paul and filed in the Office of the Clerk of the District Gourt of Ramsey County, Minnesota, within. twenty (20) days from the date of the service of this Order, a Motion for Summary Enforcement of this Order to raze and remove the said buildings will be made to the Ramsey Goun.ty District Gourt. 3. In the event that the buildings are to be razed by the City of Saint Paul pursuant to judgment of the Dis- trict Court, all personal property or fixtures which may unreasonably interfere with the razing and removal of these buildings shall be removed within ten (10) days from the entry of judgment; and if not so removed, the City of Saint Paul shall remove and dispose of such personal property and fixtures as provided by law. 4. Byrne, Mayor and Members of the City Council Re: 421 Neiderhoffer - Condemnation No. 1917 Gentlemen: The Building Department is hereby submitting its report on the condition of the property known as 421 Neiderhoffer, a frame duplex, 12 stories in height with a partial basement, approximately 19 feet wide, 41 feet long and 26 feet in height. The owner of record is Elsa Mickelson and Peter E. Mickelson and the following appears to have an interest, Ramsey County Welfare Board. The legal description of the property is Lot 4 in the N. '� of Block 15, Stinson Brown and Ramsey Addition. A recent inspection indicates that the property is vacant, standing open and in a dilapidated condition. EXTERIOR Covered with imitation asphault siding is in poor condition with sections being torn and other areas of the siding is loose. The roofing material is in poor condition with some of the shingle tabs broken. The two chimneys are in a very dilapidated condition. Many bricks have already fallen and others are in a loose condition ready to fall due to the mortar being eroded from between the bricks. The front porch is in a poor condition with the decking rotted and loose in many places. A rear stairway to the second floor on the exterior of the building is badly damaged with the section of the railing on the platform completely broken off and laying on the ground and the handrail serving the stairs is also broken t .\• Thomas R. The roof structure providing some protection at the rear of the building has collapsed and is laying on the ground. All of the windows are broken and many of the sashes have been damaged to the extent that they are beyond repair. BASEMENT The basement is only a partial excavation with an access through a trap door that is broken in the kitchen area. FIRST FLOOR Contains four rooms that are in very poor condition with the plaster badly cracked, the flooring sagging and the interior littered with much debris. SECOND FLOOR Contains four rooms. The condition is similar to that on the first floor with all the interior doors and windows broken and floor littered with debris. There are no sewer or water connections to the property. The heating in the building was by stove heat, which is no longer in the building. The rear of the property has an accessory building approximately 16 feet wide, 10 feet long and 10 feet high apparently used as a shed and is in an advanced state of dilapidation. If it is the opinion of the owners of this property that it can be rehabilitated, it will be necessary that they submit the list of corrections which they propose regarding the structural condition of the buildings, as well as electrical, plumbing and heating systems, with a schedule for the completion of the rehabilitation program, along with the application for permits. If the foregoing schedule is not submitted by the owners, it is the conclusion of the Bureau of Public Buildings that by reason of inadequate maintenance, dilapidation, physical damage, unsanitary condition and abandonment, the above structures constitute a hazard to public health, safety and welfare. \ � • ' � Mayor Thomas R.
