RESOLVED, by the Council of the City of Saint Paul, pur-
suant to the applieable Minnesota State Statute, Section 117.�-2,
Minnesota Statutes Annotated, that an appeal having been taken
thereto and now is pending in the Diatrict Court in and for the
County of Ramsey and State of Minnesota, from the Award of
Damages in the amount of $1875.00, as rnade and confirmed by the
prior resolution of' this Council, C. F. 233686, approved May 31,
1967, for the condemnation and taking under power of eminent
domain, by said Ci�y of the following deseribed land, situ�te
therein, to-wit :
Thae North 1/2 of Lot 2�+, Block 30,
Suburban Hills , in the City of
Saint Paul, according to the plat
thereof on file and of record in
the office of the Register of Deeds
R� �� in and for Ramsey County, Minnesota;
in and bg that certain public improvement proceeding instituted,
conducted and completed ther�efor by said City under applicable
provisions of its Home Rule Charter, in the matter of condemning
__ and taking said property f'or park and recreation use; that hereby
said Council appropriates and �ets aside in the Treasury of said
City, in a fund therein to be known as The Condemnation and Award
Fund, a sum of money equal in amount to said Award of Damages, to-
� � wit the sum of' $1875.00, and does hereby provide f'or the retention
o thereof therein during the pendency of said appeal, and, further,
� that the Playground Real Estate Fund 3700 be eneumbered to the
o extent of the above recited Award pendin� disposition of said
o appeal, available at all times for the payment thereaf upon demand
a to whomsoever shall be shown to have a clear right thereto, and
� hereby further pledges the full faith and credit of said eity for
,s the payment of any increase of said Award of Damages allowed upon
� said appeal, and that said appropriation is made from the funds of
the City heretofore appropriat�d and made available therefor.
