WHEREAS, The Contractor and the City entered into an agreemerit dated October 16, 1g67, wherein the contractor agreed to furnish and deliver to the City all labor, materials and equipment required for the grading and paving of Shepard Road � from Davern Street to Rankin Street , and Youngman Avenue from M�,y-n.�r d Drive extended to Ranl�in Street and all other work shown for the coni;ract P-318-B 1 & 2, Comptroller' s Agreement No. L-6695-17, said agreement bein; subject to Section 1 of the Specifications for Street and Sewer Construction dated April 1, 1959; and WHEREAS, It is the desire of the par-ties to the said �� d r r -agreement to amend the sarue by provlding an inco po ating I�'�� therein a special provision amending Section 1. 57 of the said I j Specifications for Street and Sewer Construction; now, therefore, ( IT IS �IEREBY AGREED by and between the parties hereto that � ithe above referred to agree�ent dated October 16, 1967, shall be iand is hereby �udified only to the extent of adding the following � ! special provision thereto: j j Speciai Provisiori: Section 1 . 5'7 of the Specifications for i Street and Se�,reY• Construr.,tion shall be modified � ito the extent th�,t ten per cent (lOf) rather I I � i � i � , i , - � ; • • 3 • tlian fifteen per cent (15 0) sliall be retained ' from partial payment to the contractor ancl after the value of the work completed exceeds fifty per eent (50?�0) o:f the contract amount , the remaining partial payments may be m�,de in full if the enbineer considers that the City is adequate�y protected and the work has been performed satisfactorily. IT IS AGREED to by and between the parties hereto that all the remaining terms and conditions of the said contract dated October 16, 196'7 , should remain in full force and effect subject to the modification contained in this Addendum to Agreement and further that this Ad.dendum shall not beco�e effective until it has been approved by Federal Insurance Company, New York, New York, as surety, for i;he performance of the said Agreement by Ashbach Construction Co.
