04-490Council File � o �- y90 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 Green Sheet # Presented By RESOLUTION CITY OF SAINT PAUL, MINNESOTA �y Referred To Committee: Date WAEREAS, Neighborhood Housing and Property Improvement (NI3Pn has requested the City Council to hold public hearings to consider the advisability of revoking the rental registration certificate for a single family dwelling located at 289 Moore Street and registered to John Springer and Chad Ludwig; and WHEREAS, for the entire period of time hereafter described, the same tenants have occupied this property; and WHEREAS, starting in 2002 and continuing to the present, neighbors haue reported suspected illegal drug activity at this property to the Police Department and various police officers have observed activity consistent with illegal drug trafficking; and WHEREAS, on April 16, 2002 the St. Paul Police Deparhnent executed a search warrant at this property which resulted in arrests, the seizure of drug pharaphanelia, drug use admissions, and included a suspect escaping and then making an illegal entry into a neighbor's property; and WHEREAS, on March 18, 2004 the St. Paul Police Department "tossed" the garbage for this property and found heroin residue, syringes and straws consistent with heroin use, as well as mail addressed to this property's current occupants; and WHEREAS, on March 24, 2004 the St. Paul Police Department executed a search warrant at this property which resulted in the seizure of suspected heroin and with drug pharaphanelia consistent with drug trafficking; and WHEREAS, Legislative Code §51.06 (a) (ii) provides that a determination by the Director of Neighborhood Housing and Properiy Improvement that use and occupancy of the dwelling which constitutes a nuisance is grounds for revoking a rental registration certificate; and WHEREAS, on April 16, 2004, NHI'I sent John Springer and Chad Ludwig the proper Notice of Intent to Revoke Rental Registration (copy attached); and WHEREAS, 7ohn 5pringer and Chad Ludwig have not appealed said notice and the time for filing an appeal has expired; now therefore BE TT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the following findings and order concerning the subject properiy at 289 Moare Street: 3015119 oy- y �o 1. That the subject property is a rental single family dwelling that is required to be registered with the City's Rental Registration Program. 2. That the holder of the Rental Registration Certificate for the subject properiy is John Springer and Chad Ludwig. 3 That a nuisance incident as defined by Chapter 45 has occurred at the subj ect property and use and occupancy of the subject property continues to be a nuisance. C� That the notification requirements of Chapter 51 have been fulfilled and the time for an appeal has expired without an appeal being made. ORDER The Saint Paul City Council hereby makes the following arder: 1 The above-referenced Rental Registration Certificate issued to John Springer and Chad Ludwig for the property at 289 Moore Street, Saint Paul, MN is hereby revoked. 2. I have refeaed this matter to the St. Paul City Councii with a recommendation to revoke the rental registratiun certificate. The City Council will revoke unless an appeal is filed in the next ten (10) days from the date oF th i•t notice. An appeal may be filed pursuant to legislative Code § 18.02, by appearing in person between the hour's of 8:00 a.m. and 430 p.m. on any business day at the City Clerk's Office, Room 170, City Hall, 15 W. Kellu;�r Boulevard, St. Paul, MN or you may appeal by mail within the same 10 day time line. Once the City Council has revoked the rental registration certificate, occupancy of the properry is not allowvl until (1) an inspection by Neighborhood Housing and Property Improvement (NHpn has been conducted, (21 the Director of NHPI has determined the properiy to be in compliance with the city code and no longer constitutes a nuisance, and (3) the certificate is renewed. Note: Renting a property without a certificate is a misdemeanor. Please call me as soon as possible to arrange a meeting to discuss how to correct this situation before the Cit� Council acts to revoke this certificate. If all issues aze addressed, I will recommend that the revocation be withdrawn from consideration by the City Council.
