RESOLUTION AUTHORIZING APPLICATION TO THE MINNESOTA DEPARTMENT OF
EMPLOYMENT AND ECONONIIC DEVELOPMENT AND TO THE METROPOLTTAN COUNCTL FOR A
CONTAMINATION CLEANUP GRANT FOR TE� lO AND-JACKSON BUII�DING.
WHEREAS, the City of Saint Paul, Minnesota is a participant in the Livable Communities AcYs Housing Incentives
Program for 2004 as determined by the Metropolitan Council, and is therefore eligible to make application for funds under
the Tas Base Revitalization Account; and
WH�REAS, the City has identified a clean-up project within the Ciry that meets the purposes and criteria of the
Contamination Cleanup Grant Prograxn ofthe Minnesota Department ofEmployment and Economic Development (DEED)
and the Tax Base Revitalization Account Grant Program of the Metropolitan Council; and

WI3EREAS, the City has the legal authority to apply for financial assistance, and the institutional, managerial and
fmancial capability to ensure adequate project administration; and
WHEREAS, the City of Saint Paul certifies that it has not violated any Federal, State or local laws pertaining to fraud,
bribery, graft, kickbacks, collusion, conflict of interest or other unlawful or corrupt practice and that it will comply with
all applicable laws and regulations as stated in the contract agreements; and
WHEREAS, the City of Saint Paul, Minnesota agrees to act as legal sponsor for the project contained in the joint cleanup
grant application submitted to DEED and the Met Council on May 3, 2004;
NOW, THEREFORE, SE IT RESOLVED that the City Council of the City of Saint Paul, Minnesota hereby approves
the joint Contamination Cleanup graxit application submitted to the Depariment of Employment and Economic
Development (DEED) and the Metropolitan Council on May 3, 2004 by the City of Saint Paul for the 10�' and Jackson
Building; and
BE IT FURTHER RESOLVED that the sources and amounts of the local match identified in the appiication are
committed to the project identified; and
BE IT FUR1`f�R RESOLVED that upon approval of its application by DEED and the Metropolitan Council, the City
of Saint Paul may enter into an agreement with them for the above-referenced project, and that the City of Saint Paul
certifies that it will comply with all applicable laws and regulation as stated in all conh-act agreements; and
BE TT FURTHER RESOLVED that the Director of the Department of Planning and Economic Development is hereby
authorized to execute such agreements as are necessary to implement the project on behalf of the applicant.

11 Transient Boats The Public Dockwill not function as competifion forthe SPYC transient boat
business. Ovemighting boats will be located in the marina harbors whenever
possible. Overnighting boaters that aze registered overnight guests at the
floating bed & breakfast will be peimitted to overnight their boats on the
Public Dock
In the event that a transient boat must overnight on the dock (late arrivals, fu11
hazbors), it will be pemutted on the outside edge of the dock only.
The SPYC will retain all transient fees that it collects. The CITY and SPYC
may mutually agree that the SPYC act as the CITY'S agent for managing
transient boat services on the Public Dock.
2) Use of the Boats that may tie-up to the inside of the dock will be limited to those of
Inside ofDock a masimum width of 10 feet (see attached illustration). Lazger boats may tie
up to the outside of the dock only.
Overnighting in most cases will be lixnited to the outside of the dock. This
is to avoid navigational conflicts with the neighboring SPYC dock.
3) Locating Facilities The CITY will not locate a restaurant or other public facility along the inside
edge of the dock other than in the area be° nn;ng from where the dock meets
the shore to the point where the inside edge of the dock first drops to a lower
rier (see attached illustration).
The City will lisnit the width of facilities to be located within this defined
area to a maYimum of 34 feet. This is to sninimize potential navigational
conflicts with boats located along the neighboring SPYC dock.
The potential location of any facility along the outside edge ofthe dock is not
affected by these criteria.
41 Signaee The CITY will post si�age reflecting the previous informarion as well as
dock hours (not to exceed park hours), reporting procedures for transients,
etc.
The CITY will work with the SPYC in developing and locating signage.

Assignment of a��ailable slips ���ill be made on a first-come,
first-ser`�e basis, takin� into consideration the size of the boat and the
sizes of the a�•ailable slips. A«�aiting list ���ill be kept of those
seeking slippage at the St. Paul Yacht Club facilities, and �vho have
completed the slip application form and �vho ha��e made the required
deposit to the St. Paul Yacht Club. The deposit «�ill be credited
toz��ard dockage ���hen an assi�nment is made. The �vaiting list
defines the order in �vhich the applicants for dockage receive their
slip assignments. The «aiting list is open to an5� boater desiring
doc�age. When an applicant has been notified of an opening, he or
she has one �veel: to accept or reject the slip. Residents of the City
of St. Paul �vha meet the abo�-e criteria ���ill be gi� preference in
slip assignments. Waiting lists �vill be updated annually. If a slip
assignment has not been made, the person may elect to remain on
the �vaitin� list, or the deposit «-i11 be refunded. �
