04-479Council File # �T "I 7 % Green Sheet # �/ l s � !CJ RESOLUTION CITY OF SAINT PAUL, NIINNESOTA Presented By Referred To /3 Committee: Date 2 Whereas, On or about September 19, 2003, Yang Yang, in zoning file no. 03-371669, 3 made application to the Board of Zoning Appeals (hereinafter, the "BZA") for a variance from 4 the strict application of the provisions of the Saint Paul Zoning Code for property located at 1177 5 Clarence Street and legally described as Kiefer-Pazk S'/z of L,ots 22 Thru 28 BLK 1; and 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 Whereas, The purpose of the application was to vary the standards of the Zoning Code for off street parking in order to reestablish a restaurant on the said property; and Whereas, The BZA conducted a public hearing on November 10, 2003, after having provided notice to affected property owners, and the BZA, by its Resolution No. 03-371669, dated November 10, 2003 denied the said appiication based upon the following findings and conclusions: The property in question can be put to a reasonable use under the strict provisions of the code. In 1999 City Planning staff determined that 70 off-street parking spaces were needed far the restaurant. At that time there were 12 spaces in front of the building, 23 spaces at the rear of the building and 21 spaces on the south side of Rose Street. There was also a shared pazking agreement with the Bank building that used to be located on the south side of Rose Street for an additiona125 spaces. The previous property owner obtained an encroachment permit for parking spaces in the Rose Street right-of-way but since the permit was subject to termination at the discretion of the City, those spaces were not counted. Since that time, the bank building has been removed and the spaces on the south side of the street are no longer available. If the 7 spaces in the right-of-way are subtracted because they may be terminated at any time, 38 on-site parking spaces remain. This is less than half of the number of spaces that were available when staff last reviewed the property in 1999 and is not sufficient for a restaurant with 13,000 square feet of gross floor area. This property is located in a B-2, Community Business, zoning district. There are many less intense office and service type businesses that could be established in this building without crearing such a large parking deficit. Page 1 of 4 o�t - ��9 2 2. The plight of the land owner is not due to circumstances unique to this 3 property, and these circumstances were created by the Zand owner. 4 5 The history of the property reveals that there is cturently substanfially less 6 parldng available than there was in the past due to the loss of shared 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 pazking to the south. There is nothing unique about this property that would prevent a more reasonable use to be established. 3. The proposed variance is not in keeping with the spirit and intent of the code, and is not consistenf with the health, safety, comfort, morals and welfare of the inhabitants of the City of St. Paul. The City, working with the District 2 Plauniug Council, various neighborhood organizations, private developers and state agencies, developed the Phalen Village Master Plan. The Plan was formally adopted in 1995 and the major goals of that plan have not changed. The Plan calls for the renovarion of existing housing and the creation of new housing units of various types. The Plan also calls for the establishment of mare open space and park land as well as developing more neighborhood oriented business and service establishments. Allowing the referenced building to be reopened as a restaurant with a major pazking shortfall would not be consistent with Comprehensive Plan. A less intense office or service type use would require less pazking and be more compatible with the residential uses to the north and south and the proposed residential use to the west. The requested variance is not in keeping with the spirit and intent of the code. 4. The proposed variance will not impair an adequate supply of light and air to adjacent property, nor will it alter the essential character of the surrounding area or unreasonably dianinish established property values within the surrounding area. The applicant is not proposing any additions to the building or changes to the exterior property areas. The requested variance would not affect the supply of light or air to adjacent property. Without adequate off-street pazking, customers of the proposed restaurant would be forced to park in the street or to use the parking facilities of nearby businesses or residenrial developments. The applicant has obtained a monthly lease to use the off-street parking spaces of the convenience store at 1186 Prosperity. However, these spaces would only be available after the convenience store closes at 9 P.M. and they are located almost 300 feet away from the restaurant. The peak hours of the restaurant would be prior to the closing time of the convenience store and therefore cannot be counted to meet pazking requirements. Establishing a restaurant at this location without adequate off-street pazking would have a negative impact on surrounding properties Page 2 of o�- y�� Z 5. The variance, if granted, would not permit any use that is not permitted 3 under the provisions of the code for the property in the district where the 4 aff'ected land is located, nor would it alter or change the zoning district 5 cZassifzcation of the property. The request for variance is not based primarily on a desire to increase the value or income potential of the parcel of land. The applicant states that he wants to open a restaurant in this locarion rather than a business that would require less parking. Whereas, Pursuant to the provisions of Leg. Code § 64.205, Yang Yang , on December 2, 2003, duly filed an appeal from the determination made by the BZA and requesting a hearing before the City Council for the purpose of considering the actions taken by the said Board; and Whereas, Acting pursuant to I,eg. Code §§ 64.205 -.208, and upon noUce to affected parties, a public hearing was set on for hearing before the City Council on December 17, 2003 but the public hearing was further continued to January 7, 2003; and Whereas, On January 7, 2004, the City Council duly conducted a public hearing on the said appeal where all interested parties were given an opportunity to be heazd; and Whereas, The City Council, having heazd the statements made, and hauing considered the variance application, the report of staff, the record, minutes and resolution of the BZA, does hereby Resolve, To uphold the decision of the BZA in this matter, based on the following findings of the City Council: Having failed to show that the BZA had erred in its facts, findings or procedures and with out any other alternative to the parking shortfall, the decision of the BZA denying the applicant's variance request is upheld. We also beiieve that the Zoning Board was influenced by discriminatory statements made by certain individuals that spoke at the meeting that were intended to inflnence the. vote on this variance. Specificalty, that the prior use of the dwelling had been an Asian Night Club atld the Night Club had been mismanaged and became a nuisance to the neighbors and community and had been shut down by the City. I and my rivo partners purchased the building for the purpose of opening up an Asian restaurant, nat serving beer, wine or having entertainment. The Asian population on the East Side of St. Paul has doubled and tippled in the last 15 years and, though our restaurant would serve ail individuals, cleariy the need for a restaurant coincides with its growing Asian population. Would have the Council have denied this variance if it was a Kentucky Fried Chicken ar some othec restaurant. We believe that tha Board was swayed by ihe conduct of the prior owner who operated an unruly and poorly managed business, he was also Asian. T believe that a great deal of emphasis has been put on the facts of the prior owner and attributing those facts to myself, though I am not related, I have no connection with that person, but I also happen to be Asian. Statements were brought up at both the East Side Council meeting and the Zoning meeting that attributed the conduct of the prior owner to lead people to believe that this is the kind of conduct that they would be aliowing if they allowefl me to have my restaurant, which is totally false and is a prejudice to myself. My background is in restaurants and my gar�iers' background is in restaurants and there is no intent of opening a bar or sezving any type of alcoholic beverages at this location. operating a very good rzstaurant. We are just conforming to the previous use of the building and it is our intent to serve the community as well in The City, through Mr. Hardwick, is indicating that the plan for this area is for Green Space and industrial office space is unrealistic in Lhat iT would require acqnizing all af the businesses an this Street. The building and reat estate in question here is only a narrow building and by itself �vouid not benefit the community as Green Space and we believe woul�' not better the community as an office park. The remaining portion, with the onginai bar'restaurant was sold to a private party. Last year, the previous owner, Dinner Club 2000, after a long history of problems, had their Iiquor license and Certificate of Occupancy revoked. The building remamed vacant for almost a year before the applicant purchased the property. Yan� Yane (#03-3716691 1177 Clarence Street• A variance of the off-street parking requirements in order to reestablish a restaurant on this site. The restaurant requires70 parking spaces and 45 spaces are available, for a variance of 25 spaces. Mr. Hardwick showed slides of the site and reviewed the staff report with a recommendation far denial. No correspondence was received opposing the variance request. One letter was received from District 2 opposing the variance request. • Ms Marton questioned Mr. Hardwick about the parking spaces leased by the applicant, whether they were two streets away from the establishment. Mr. Hardwick stated that is correct. Ms. Morton further questioned whether the shortest route would be across the McDonald's property and by taking a different route it would be further than 300 feet from the establishment. Mr. Hardwick replied that is correct. The applicant YANG YANG, 762 Case Avenue, was present. Mr. Yang argued that thz actual square footage of the building is different from what has been stated in the staff report. He plans to use only the upper level not the lower level so the square footage wouid be half as much as the total square footage for the building. Mr. Yang submitted a handout to the Board showing his measurements of the building. Mr. Yang argued that by only using the upper story of the building and only the restrooms on the east side of the building he would only need 35 paricing spaces. Mr. Yang claimed to have a petition signed by 300 families and 12 organizations from the neighborhood, supporting his project. Ms. Maddox asked to see the petition. Mr. Yang stated he had not brought the petition but has it at home. Noting that he will provide a copy for anyone that wants to see it. Mr. Yang stated he just wants to open a restaurant in the building far the neighbors and the community. There was opposition present at the hearing. Mr. Chuck Repke, 1961 Shercvood Avenue, District 2 Community Councii, spoke of the problems caused by the previous Dinner Club 2000. Mr. Repke explained the history of the restaurant and the actions that were necessary to end the problems created by the club for the neighborhood. Noting that the case had to be settled by an Administrative Law Judge, who revoked all licenses for the Dinner Club 2000. In conclusion he stated that granting any kind of variance to reestablish an entertainment business for this . piece of land of any kind would in effect be taking the revocation process and deeming it useless. The current owner is Mr. Yang who is buying the building on a contract for deed. The value of the building its self is enhanced by any action the taken by the Boazd that facilitates the properry to again be used as a restaurant for which it does not t�ave adequate parldng. Previously the restaurant had the parking spaces to the south of the building but the customers stiIl parked all over the adjacent parking areas for neighboring businesses. So the imposirion on the neighbors has always been high. He stated that he had no idea how using only half of the building could be enforced. Mr. Yang stated that he is financing the building at Western Bank. He azgued that the iestaurant would not be like Club 2000. It wi11 only be for food service. A place for neighbors to meet and have dinner. Mr. Courtney requested that Mr. Hardwick comment on the City ordinances and the recalculation of the square footage provided by Mr. Yang. Mr. Aardwick explained how the squaze footage of a building is caiculated by the CiTy. Noting that the only thing that gross floor azea does not include is unfmished basements and attics. The basement is finished so even though the applicant states he is not going to use the basement must be counted, because it meets the definition of gross floor area for pazking purposes. LIEP staff visited the site and measured the building because there were a couple of different sets of measurements submitted by the applicant. LIEP's inspector came up with measurements of the exterior of the building were 110 feet by 58 feet, with two ]evels comes up to about 13,000 square feet. The figure of 70 off-street pazking spaces was calculated by the Planning Staff in 1999, prior to Dinner Club 2000 moving into the building. While it was still Mangini's and there was sfill parldng available at the bank across the street. If we had a new building of that size, it would require 102 off-street parking spaces. So based on the deternvnation made by the Planning Department in 1999 we are only requiring 70 off-street parking spaces. Establishing that as the base for a non-conforming status on the existing parking. Neither the 102 nar the 70 off-sh parking spaces included the spaces in the right-of-way, however, staff did include them. But if those spaces were not counted the variance needed would be even larger. Hearing no fiirther testimony, Ms. Maddox closed the public portion of the meeting. Ms. Morton moved to deny the variance and resolution based on findings 1 through 6. Mr. Kleindl seconded the motion, which passed on a roll call vote of 6-1 {Courtney).
