C I T Y O F S A I N T P A U L Ass't Valuation Engineer BUREAU OF VALUATIONS 286 City Heil Saint Paul, Mienssota 55102 � February 9, 1968 To the Honorable Mayor and City Council City of Saint Paul Gentlemen: Re: Condemn and take slopes, and grade and surface with bituminous material, Ross Ave. from Hazelwood St, to Germa�n St; also construct public sewer in Ross Ave, from a point 125 ft. , more or less, west of Germain St. , to Hazelwood St. This report is prepared pursuant to the request of the City Council on January 17, 1968, at the hearing on the ratification of the assessment for the grading and sewer orders in Ross Avenue. The first portion contains a history of the proceedings followed by the recommendations of the Department of Finance and the Department of Public Works. The hearings on the above subject improvements were before the City Council on May 4, 1965, on the basis of established formulas and policy for assessments with estimated rates as follows: Grading Ross Avenue - $17.00 per assessable foot Sewer - Ross Avenue - $ 9.30 per assessable foot A report to the Commissioner of Finance (copy attached) was presen- ted to the City Council on that date of May 4 recommending a depart- ure from the usual formulas for assessing this particular improve- ment and that the following formulas apply: l. That the corner lots whose long sides abut the pro- posed improvement be assessed 40% of the actual frontage instead of the usual formula of 50% of the actual frontage, restricted to a depth of 125 feet. 2. That where the sewer abuts the corner lot, said corner lots be assessed a maximum of $75�..00, without restriction as to the depth of the lot. � -z- 3. That all other lots and parcels of land abutting only on Ross Street be assessed on the basis of their full frontage with no allowance given because of the propertyTs elevation being below the grade of the future Ross Street. These formulas would result in the following estimated assessment rates: Grading Ross Avenue - $14.25 per assessable foot Sewer - Ross Avenue - $ 7.28 per assessable foot The Council adopted the report and laid over or continued the hear- ing to June l, 1965, with new notices to all abutting owners advising of the proposed basis of assessment. On June 1 the Council approved the final orders for all of the subject improvements. The slope order was processed and the ratification of the awards for slope damages was approved by the Council on August 4, 1965. Slope awards were paid to two property owners for improvements in place within the easement areas. The total expenditures on this order amounted to $180.60. The grading and surfacing and sewer construction work was completed during the 1967 conatruction season. Public Works has reported final costs and the assessment rolls were processed for hearing of January 17, 1968, with an additional four-week lay-over to February 14, 1968. New notices of the revised hearing date were sent to all abutting owners. Objections have been made concerning damages for slopes. As previ- ously stated, the City Council ratified the award of damages for slopes August 4, 1965,, prior to performing the work. Slope awards are based on the value of, or damage to the existing in-place improve- ments. It is often difficult to anticipate all elements of damage prior to the construction work. Should the property owner conclude there were inequities in the award, I would recommend a letter be filed with the Council as a elaim for damages to be processed and investigated further by the Corporation CounselTs Office and the Bureau of Valuations. The various engineers' estimates and final costs, as furnished by Public Works, are as shown on the attached sheet. As shown, the final cost reported for sewer exceeds the (preliminary) engineer's estimate by approximately 23 percent. This was a combined project, however, as bid by the contractor including the rough grading and sewer under one contract with City Forces performing the fine grading and surfacing work. Although the separate rep orted final costs for sewer exceeds the original estimate by approximately 23 per cent, the combined total expenditures on this project exceeded the combined estimates (preliminary) by only 6.14 per cent. It must be emphasized that the � -3- preliminary rates are only estimates and not guaranteed rates. It is policy where a contractor's bid exceeds the preliminary estimate by more than 10/, a hearing on the award of contract is held so as to notify the affected owners. Since the combined increase was approximately 6%, no notices were sent. The assessments for sewer and grading have been processed in accordance with recommended pro- cedure stated above, with final assessable rates as follows: Grading Ross Avenue - $14.03 per assessable foot Sewer - Ross Avenue - $ 8.972 per assessable foot The assessment for sewer on long side properties is $75 with full assessment on the interior lots. An additional charge of $6.30 per parcel of property is made to cover costs of notices, publications, court costs, etc. The processing of the orders has been performed in conformance with the previously recommended and adopted procedures. I would, therefore, recommend ratification of these orders. However, since the amounts of the assessments are a burden on some property owners, I would also recommend that the assessment be placed on a ten year installment basis. New notices of the revised hearing date were sent to all abutting owners. Objections have been made concerning damages for slopes. As previ- ously stated, the City Council ratified the award of damages for slopes Au�ust 4, 1965, prior to performing the work. Slope awards are based on the value of, or damage to the existing in-place improve- ments. It is often difficult to anticipate all elements of damage prior to the construction work. Should the property owner conclude . there were inequities in the award, I would recommend a letter be f iled with the Council as a claim for damages to be processed and , investigated further by the Corporation Counsel's Office and the Bureau of Valuations. The various engineers' estimates and final costs, as furnished by Public Works, are as shown on the attached sheet. As shown, the final cost reported i'or sewer exceeds the (preliminary) engineer's estimate by approximately 23 percent. This was a combined project, however, as bid by the contractor including the rough grading and sewer under one contract with City Forces performing the fine grading and surfacing work. Although the sep,arate reported final costs for sewer exceeds the original estimate by approximately 23 per cent, the combined total expenditures on this project exceeded the combined estimates (preliminary) by only 6.14 per cent. It must be emphasized that the � __,_ preliminary rates are only estimates and not guaranteed rates. It is policy where a contractorTs bid exceeds the preliminary estimate Uy more than 10/, a hearing on the award of contract is held so as to notify the affected owners. Since the combined increase was approximately 6/, no notices were sent. The assessments for sewer and grading have been processed in accordance with recommended pro- cedure stated above, with final assessable rates as follows: Grading Ross Avenue - $14.03 per assessable foot Sewer - Ross Avenue - $ 8.97z per assessable foot The assessment for sewer on long side properties is $75 with full assessment on the interior lots. An additional charge of $6.30 per parcel of property is made to cover costs of notices, publications, court costs, etc. The processing of the orders has been performed in conformance with the previously recommended and adopted procedures. I would, therefore, recommend ratification of these orders. However, since the amounts of the assessments are a burden on some property owners, I would also recommend that the assessment be placed on a ten year installment basis.
