An ordinance amending the Zoning
Code, Chapters 60 to 64, inclusive, of
the Saint Paul Legislative Code, per-
taining to Use Districts, Height Districts
and Rezoning of certain properties in the
City of Saint Paul, as amended.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to 64,
inclusive of the Saint Paul Legislative Code, pertaining to
Use Districts, Height Districts, and Rezoning of certain
properties in. the City of Saint Paul, as amended, be and the
same is hereby further amended so as to rezone the following
described property from "C" Residence District to Commercial
District , to-wit:
Lots 52A, 53, 54, 55 and except the
south 2 feet, Lot 69,, Howard Park;
situate on property located on the east side of Fairview Avenue
between University and Shields Avenues and one lot located on. the
west side of Beacon Avenue between University and Shields Avenues
in the City of Saint Paul.
Section 2. This ordinance shall take effect and be in
force thirty (30) days from and after its passage, approval and
publication.

� scheduled for a hearing before the City Council on November 2, 1y67.

i Due to the fact that the City is planning on acquiring a portion
j of the above land for the widening of Fairview Avenue, I recommended
i that the rezoning hearing be laid over until November 16, 1967.
This was to allow the City and Har-Mar Incorporated time to reach
i an agreement to the effect that the proposed rezoning, if granted,
would not affect the value of that portion of land to be acquired
� by the City for the Fairview widening. A copy of the agreement
� is attached, whereby the interest of the City for the future land
acquisition noted above is adequately protected.
The conditions proposed and agreed to should become a part of and
be incorporated in the rezoning petition.

This is written in response to the petition of Leonard A. Loftus
�o rezone from "C" residence to commercial district four lots on
! the east side of Fairview Avenue between University and Shields
, Avenues and one lot on the west side of Beacon Avenue been Univer-
sity and Shields Avenues. The property is described as Lots 52A,
,I 53, 54, 55 and except the south 2 feet, 69, Howard Park.
This matter was considered at October 5, 1967 Board of Zoning meet-
ing. The petitioner wishes to develop the property for customer
and employee parking for the new car sales use to the north. The property
has 180 feet of frontage on Fairview Avenue and 40 feet of frontage on
Beacon Avenue with an area of 26,562 square feet. The area to the
north is zoned light industry and co�nercial while the rest of the
' surrounding area is zoned "C" residence. The surrounding uses are
as follows: north, new and used car sales and repair facilities and
parking; east across Beacon Avenue, single-family; south,single and
I two-family; and west across Fairview Avenue, an apartment and a single-
� family dwelling with a telephone answering service use. The Compre-
hensive Plan proposes R-6, multiple family, for the property.
It was the findings of the Board that it would be reasonable to
rezone the property. Fairview Avenue is a heavily used collector
street, and there also is a non-residential use and a large apartment
across Fairview Avenue. Moreover, there is presently a parking lot on
the corner of Beacon and Shields Avenues. Therefore, the Board of
Zoning reco�nends that the petition be granted and the property re-
! zoned to commercial.

, SUFFICXENCY: The Eommissioner of Finance in a letter dated September 19, 1967,
declared the petition sufficient with the owners of 24 of 29 parcels (82.76%)
within the prescribed 100 feet having signed the petition.
B. HISTORY OF PAST ACTIONS: None on groperty. Lot 70 Howard Park was rezoned in Oct. 1960.
The staff recommended approval, the Board recommended denial. The matter had been
heard by the Board in May at which time both staff and Board approved the rezoning,
Har-Mar Inc. in a letter dated September 19, Z960, said that they would ultimately
rezone Lots 5?A, 53, 54, & 69 Hocvard Park to commercial and dedicate a new alley
across the south 20 feet of Lot 54. All rezoned property would be used for parking.
The property used by Midway Ford on the north corner of Feronia and Dewey was re-
zoned �in Oct. 1958 and March 1960. The property rezoned in Oct. 1958 was restricted
to parking. Staff and Board both approved the rezonings.
. PROPOSED USE: The property is to be used for an employee and customer parking lot.
. A.REA & FRONTAGEs Four of the lots in question have a frontage of 180 ft. on Fairview
with a depth of 126,25 ft. and one of the lots has a frontage of 40 ft. on Bea.con
with a depth of 127.5 ft. resulting in an area of approx. 26,562 sq. ft.
. ZONING IN ADJACENT AREAS: The adjoining land to the north is zoned commercial and
light industry. The rest of the surrounding zoning is "C" residence.
. COMPREHENSIVE PI�AN: The Comprehensive Land Use Plan recommends the property for R-6
which corresponds to the zoning category of C=1. The Plan also recommends R-6 for
� the area east of Fairview (except the University Ave, frontage) and R-7 for the
area west of Fairview (except the University Ave. frontage). University Ave. is
proposed for co�nercial. �

Hearing - November 2, 1967
This is to advise that the City Council has initiated proceed.ings
with the passage of a preliminary order, C.F. No. 227234, approved
February 15, 1g66, to acquire portions of the above referenced pro-
perty as shaded red on the attached plan. This acquisition is for
the opening and widening of Fairview Avenue in connection with the
proposed i�provement of Fairview Avenue from St. Anthon�y Avenue to
University Avenue.
The appraisals on this land axe essentially complete, based on the
present "C" residence basis of zoning. The acquisition proceedings
by the City will be processed in the ver3r immediate future.
Since the rezoning of the land at this time could possibly affect
the costs for this land acquisition, I would recormnend that the
City Council lay this matter over for a period of two weeks, in
which time this office will attempt to negotiate an option agreement
for the purchase of that property to be acquired by the City ineluded
in this proposed rezoning.
