Dear Sir:
This is in reference to the appeal of Hanover Apartments to extend the use
allowed in a "C" residence district to include the westerly 1/2 of vacated
Virginia Street between St.Anthony and Central Avenues and also the appli-
cation for a permit to install a 98 car parking lot. The general area of
the parking lot is between Ravoux and Fuller Avenues, and between Farring-
ton and Virginia Streets and is more specifically described in the attached
legal description.
The applicant proposes a 96 unit multiple family apartment development for
the area.
These matters were considered at the October 5, 1967 Board of Zoning meet-
i ing. The staff reported that the rezoning in the area to commercial and
"C" residence in 1958 did not include the westerly 1/2 of vacated Virginia
Street between St. Anthony and Central Avenues. This approximately 65' by
165' strip is zoned "B" residence. The area zoning includes "C" residence
to the north, east and south, and "B" residence and commercial to the west.
Existing area development includes mixed residential uses to the north,
an apartment development and park to the east, and the Ober Boys' Club and
commercial development to the south and west.
IIn regard to the appeal to extend the use allowed in a "C" residence dis-
trict to the whole site, it was the finding of the Board that the land in
question was inadvertently omitted from the rezoning action of 1958 and it
� is reasonable to extend the "C" residence use as requested.
In regard to the permit for a 98 car parking facility, the plans will meet
the design standards if the southerly parking lot is moved north so as to
i provide an eight-foot buffer along the south property line. The Traffic
Engineer has approved the plan as to traffic.

Therefore, the Board of Zoning recommends the approval of the appeal to
extend "C" residence use to the entire property, and recommends approval
of the 98 car parking lot provided that the southerly parking spaces are
moved 6' north.

The undersigned, as attorney for Hanover Development Corporation, hereby
' presents on behalf of his clients on the property hereinafter described, an
appeal from the determination of the Board zoning the property non-multiple
dwelling. The property affected herein is as follows:
"The Westerly 1/2 of vacated Virgini2 Street between St. Anthony
and the vacated alley between St. Anthony and Central Avenue."
, The reasons for appeal of the commission�s determination are as follows:
� 1. This property is totally contiguous and contained within a
larger tract more particularly described as:
"That portion of Lot 4 lying Northerly of a line
commencing on the Westerly line of said Lot 4 at a
' point 206.77 feet North of the Southwest corner of
said Lot 4 and extending Easterly to the Easterly line
of said Lot 4 to a point 256.44 feet Northerly of
the Southeast corner of said Lot 4, Block 4, Western
Area Addition according to the plat thereof filed of
record in the office of the Registrar of Titles within
and for Ramsey County, St. Paul, Minnesota."
Said tract has been zoned multiple-dwelling specifically for a
� certain FHA sponsored apartment project, but through inadvertence,
� the said description was omitted from the determination of
multiple dwelling by this body.
2. The best and most highest use to which this property can be put
is a part of the said apartment complex to be developed thereon.
Further, the said vacated property would be totally wasted and '
, unusable under any other zoning determination.

' 3. Because of the urgency and press of time involved in the
completion requirements for the construction of the FHA
sponsored project, it is necessary to make this appeal at this
time and request that determination be made for the zoning
of said parcel for multiple dwelling use in accordance with
the zoning of the contiguous property described in Paragraph 1
above.
This appeal is respectfully submitted by the undersigned as attorney for the
Hanover Development Corporation as option holders on the said tract of real
